A RESOLUTION OF THE PIANNING COMMISSION OF THE TOWN OF DANVILLE
DETERMINING THE GENERAL PLAN CONFORMITY OF THE PROPOSED SALE OF
A PARCEL OF REAL PROPERTY OWNED BY THE DANVILLE COMMUNITY
DEVELOPMENT AGENCY LOCATED AT THE SOUTHWEST CORNER OF THE
INTERSECTION OF RAILROAD AVENUE AND LOVE LANE (APN 199-330-043) AND
THE PROPOSED PROPERTY EXCHANGE INVOLVING A PARCEL OF REAL
PROPERTY OWNED BY THE DANVILLE COMMUNITY DEVELOPMENT AGENCY
LOCATED AT THE NORTHWEST CORNER OF RAILROAD AVENUE AND LINDA
MESA AVENUE (APN 199-330-041)
WHERF~S, Government Code, Title 7, Division 1, Chapter 3, Article 7, Subsection 65402,
requires that where a General Plan has been adopted, the Planning Agency has the
responsibility as to determination of General Plan conformity prior to sale of public land;
and
WI-IERF~S, the Town of Danville does have an approved and adopted General Plan which
meets the requirements of Section 65302 of the Government Code; and
WHEREAS, Danville Square, Inc., has requested and offered to purchase from the
Danville Community Development Agency a parcel of real property described in the legal
descriptions and the plat maps attached hereto, marked Exhibit A1 and A2 respectively,
and incorporated herein by this reference; and
WHEREAS, Danville Square, Inc., has requested and offered to exchange a parcel of real
property owned by the Danville Community Development Agency for a parcel of privately
owned real property owned by Danville Square, Inc., with the two exchange properties
described in the legal description and the plat maps attached hereto, marked Exhibit B1
and B2 and C1 and C2 respectively, and incorporated herein by this reference; and
WHEREAS, the parcels in question were established into their current configurations by
way of the Railroad Avenue land acquisition and condemnation actions; and
WHEREAS, engineered plat maps for the parcels in question have been created to
precisely define the size and locations of the parcels; and
WHERF~S, a duly-noticed public hearing considering the determination of general plan
conformity of the proposed sale and exchange of real property was conducted by the
Planning Commission on March 17, 1992; and
WHEREAS, the recordation of the plat maps precisely defining the size and location of
the subject properties and the proposed sale and exchange of said properties is
categorically exempt from the provisions of the California Environmental Quality Act
(CEQA); and

WHEREAS, a staff report was prepared recommending both the proposed sale and
exchange of the Danville Community Development Agency owned properties; and
WHERFakS, the property in question has a Downtown Masterplan and zoning designation
of Downtown Business District - DBD Area 4; Residential Serving Commercial; and
WHEREAS, the proposed sale and exchange of the Danville Community Development
Agency owned properties facilitates the development of commercial uses upon the
properties in question and is consistent with the underlying general plan and zoning;
now, therefore, be it
RESOLVED that the Planning Commission of the Town of Danville does hereby certify as
accurate the plat map descriptions of the three referenced real properties and determines
that the proposed sale and exchange of real properties herein described is in compliance
with the Danville General Plan.
APPROVED by the Danville Planning Commission at a Special Joint Meeting of the
Planning Commission, the Town Council and the Community Development Agency held
on Tuesday, March 17, 1992, by the following vote:
