HomeMy WebLinkAbout91-42EXHIBIT A RESOLUTION NO. 91-42 A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF DANVILLE DETERMINING THAT THE VACATION OF A 0.08 ACRE FLOOD CONTROL EASEMENT BY THE CONTRA COSTA COUNTY FLOOD CONTROL DISTRICT IS IN CONFORMANCE WITH THE DANVILLE 2005 GENERAL PLAN WHEREAS, the Contra Costa County Flood Control District intends to vacate an excess 0.08 acre flood control easement; and WHERF~S, the site is located south of Greenbrook Drive, west of Camino Ramon, adjacent to Interstate 680, and is further identified as a portion of APN: 218-783-001; and WHERF~S, the Town of Danville has approved PUD 90-08 for development of a 52 bed residential care facility on the site; and WHEREAS, Government Code Section 65402 requires that the Town of Danville to make a determination that the vacation of this 0.08 acre easement by Contra Costa County is in conformance with the Town of Danville 2005 General Plan; and WHEREAS, the Planning Commission did review the project at a noticed public hearing on September 10, 1991; and WHEREAS, the public notice of this action was given in all respects as required by law; and WHEREAS, a staff report was submitted recommending that Planning Commission make the determination that the vacation of this 0.08 acre easement is consistent with the goals and policies of the Danville 2005 General Plan; and WHERF~S, the Planning Commission did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing. NOW, THEREFORE, BE IT RESOLVED THAT the Planning Commission of the Town of Danville makes the following findings: The proposed vacation of a 0.08 acre easement by Contra Costa County is consistent with the goals and policies of the Town of Danville 2005 General Plan.
