HomeMy WebLinkAbout91-40 EXHIBIT A RESOLUTION NO. 91-40 A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF DANVILLE APPROVING HOME OCCUPATION PERMIT REQUEST HOP 91-5 TO CONDUCT COUNSELING SERVICES AT 724 DANVILLE BOULEVARD WHEREAS, Ann Thomas requested approval of a Home Occupation Permit to conduct counseling services; and WHEREAS, the subject site is located at 724 Danville Boulevard, further identified as Assessor's Parcel Number 200-100-008; and WHEREAS, the request is categorically exempt from the provisions of the California Environmental Quality Act (CEQA); and WHEREAS, on July 23, 1991, Planning Staff circulated an appealable action letter to adjacent property owners of the subject property; and WHEREAS, on August 5, 1991,.Thomas Sanguinetti appealed the administrative action; and WHEREAS, the Planning Commission did review the project at a noticed public hearing on September 10, 1991; and WHEREAS, the public notice of this action was given in all respects as required by law; and WHEREAS, a staff report was submitted recommending that Planning Commission approve the request and deny the appeal and uphold the administrative approval of the request; and WHEREAS, the Planning Commission did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing. NOW, THEREFORE, BE IT RESOLVED THAT the Planning Commission of the Town of Danville denies the appeal and upholds the administrative action approving HOP 91-5 per the conditions contained herein, and makes the following findings in support of the Home Occupation Permit request HOP 91-5: 1. The proposed use is consistent with thc Danville 2005 General Plan. PAGE 1 OF RESOLUTION NO.91-40 0 0 The proposed use does not change the residential character of the dwelling or the neighborhood. The proposed use will not be detrimental to the health, safety and general welfare of the Town. The proposed use will not adversely affect the orderly development of property within the Town. The proposed use will not create a nuisance and/or enforcement problem within the neighborhood. The proposed use will not encourage marginal development in the neighborhood as the home occupation is an incidental use to the dwelling. CONDITIONS OF APPROVAL The home occupation authorized by this permit shall be in compliance with the applicant's letter of explanation, attached as Exhibit D of the Planning Commission staff report for this item dated September 10, 1991, except as may be modified by conditions contained herein. The home occupation shall not generate vehicular traffic in excess of that normally associated with single-family residential use. No more than one room, or twenty-five percent of the habitable floor area of the principal structure; whichever is greater, shall be used for the home occupation. 4. There shall be no exterior indication of the home occupation. There shall be no exterior signs used to indicate the presence of the home occupation. There shall be no noise, odor, dust, fumes, vibration, smoke, electrical interference with the residential use of adjacent properties due to the conduct of the home occupation. There shall be no persons employed, except the applicant, in the conduct of the home occupation. PAGE 2 OF RESOLUTION NO.91-40 o There shall be no merchandise or services for sale except that produced from or made on the premises. 9. Not more than five persons shall be counseled in any one day. 10. The two parking spaces indicated in Exhibit C of the Planning Commission staff report for this item dated September 10, 1991, shall be kept free and clear for use by business clients. 11. The counseling sessions shall be limited to weekdays (Monday through Friday) during the hours from 8 a.m. to 7 p.m. 12. Only one person shall be counseled at a time. No group counseling is authorized by this permit. 13. Violation of these Conditions of Approval shall be cause for initiation of action to revoke this Home Occupation Permit. 14. The applicant shall notify all clients that Nadine Drive is not to be utilized beyond the limits of the rear property line.
