HomeMy WebLinkAbout91-37EXHIBIT C RESOLUTION NO. 91-37 A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF DANVILLE RECOMMENDING THAT THE TOWN COUNCIL ADOPT A NEGATIVE DECLARATION OF ENVIROMENTAL SIGNIFICANCE AND APPROVE ZONING TEXT AMENDMENT ZTA 91-2 ESTABLISHING NEW SIGN REGULATIONS FOR THE TOWN OF DANVILLE WHEREAS, the Town of Danville adopted the Contra Costa County sign regulations by reference upon incorporation, amendeding it in 1987 and adopting sign policies in 1988; and WHEREAS, the Town Council appointed a 10 member sign ordinance task force to work with staff to develop new sign regulations in 1990; and WHEREAS, the proposed new sign ordinance applies to all property within the Town of Danville; and WHEREAS, all commercial property owners and business owners were invited to two public meetings to discuss the proposed ordinance; and WHERF~S, the Chamber of Commerce hosted two gatherings where presentations to businesses were made; and WHERF~S, the Planning Commission and the Town Council reviewed the draft ordinance at a study session on July 25, 1991; and WHEREAS, the Planning Commission did review the ordinance at a noticed public hearing on August 13, 1991; and WHEREAS, a Negative Declaration of Enviromental Significance was prepared for the project indicating that no significant impacts have been identified to be associated with the project; and PAGE I OF RESOLUTION 91-37 WHEREAS, the public notice of this action was sent to all commercial property owners and business owners in Danville; and WHEREAS, a staff report was submitted recommending that Planning Commision adoption a resolution recommending Town Council adoption of a Negative Declaration and approval of Zoning Text Amendment ZTA 91-2 establishing new sign regulations; and WHEREAS, the Planning Commission did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; NOW, THEREFORE, BE IT RESOLVED THAT the Planning Commission of the Town of Danville recommends that the Town Council adopt a Negative Declaration of Environmental Significance and approve Zoning Text Amendment ZTA 91-2 Sign Ordinance (Attachment A) and makes the following findings in support of the ordinance: The proposed sign ordinance complies with the Danville 2055 General Plan goals and policies. A community need has been demonstrated for a new sign ordinance that is comprehensive and well organized. The proposed sign ordinance preserves the health, safety, and general welfare of the Town. The proposed sign ordinance minimizes conflict between distracting traffic hazards and the need to identify businesses. e The proposed sign ordinance preserves the aesthetics of the community and emphasizes the harmony between Danville's architectural characteristics and it's physical setting. The proposed sign ordinance provides good identification for businesses which will encourage a healthy economic environment. o The proposed sign ordinance will integrate new development visually and functionally in a manner compatible with the physical character and desired image of the community. 8. The proposed sign ordinance will improve the appearance of the community by PAGE 2 OF RESOLUTION 91-37 abating negative elements such as non-conforming signs. o 10. The proposed sign ordinance establishes sign design standards which will enhance the character of the Danville small-town character. There is no evidence before the Town that the proposed sign ordinance will have potential for an adverse effect on wildlife resources or the habitat upon which the wildlife depends.
