A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF DANVILLE
RECOMMENDING TOWN COUNCIL ADOPTION OF A NEGATIVE DECLARATION
OF ENVIRONMENTAL SIGNIFICANCE AND APPROVAL OF GENERAL PLAN
AMENDMENT (GPA 91-5) INITIATED BY THE TOWN OF DANVILLE
FOR PARCEL J OF SUBDMSION 7480 (APN: 206-010-043)
WHEREAS, at the request of the property owner of Parcel J, Subdivision 7480, a parcel
approved exclusively as a child care site on the north side of Camino Tassajara, west of
Crow Canyon Road, authorization for a General Plan Amendment Study was granted by
the Town Council on July 2, 1991; and
WHEREAS, the property currently contains a land use designation of Public and Open
Space - General Open Space; and
WHEREAS, Sections 65350 et. seq. of the Government Code of the State of California
prescribe the procedure for adopting and amending the Town's General Plan; and
WHEREAS, the Town of Danville has initiated a General Plan Amendment Study to
consider the merits of changing the land use designation from Public and Open Space-
General Open Space to Public and Open Space-Public and Semi Public; and
WHEREAS, a staff report was submitted recommending designation of the subject site to
Public and Open Space - Public & Semi Public; and
WHEREAS, the proposed land use designation is compatible with the land use designation
and zoning designations within the area; and
WHEREAS, a Negative Declaration of Environmental Significance has been prepared for
the project indicating that, because the proposed General Plan will not intensify the
allowable land uses in the area, no significant environmental impacts are anticipated to
be associated with the project; and
WHEREAS, the public notice of this action was given in all respects as required by law;
and
WHEREAS, the Planning Commission did review the project at a noticed public hearing
on August 13, 1991; and

WItERFAkS, the Planning Commission did hear and consider all reports,
recommendations, and testimony submitted in writing and presented at the hearing.
NOW, THEREFORE, BE IT RESOLVED THAT the Planning Commission of the Town of
Danville recommends that the Town Council adopt the Negative Declaration of
Environmental Significance and approve General Plan Amendment GPA 91-07, and makes
the following findings in support of approving the General Plan Amendment:
The proposed project is consistent with comprehensive goals contained within the
Danville 2005 General Plan. General Plan Policy 7.10 encourages development of
quality child care in conjunction with park, private common areas and church
facilities which are allowed uses in the Public - Semi Public land use designation.
The General Plan Amendment will not adversely affect the preservation of present
aesthetics and other community qualities, rather has the potential to enhance and
enrich the community by making lands appropriately designated to provide
identified community needs.
The General Plan Amendment will not adversely affect the Town's ability to
maintain high,quality public facilities and services.
The General Plan Amendment will not adversely affect the quality of life within
existing developed areas of the community.
The General Plan Amendment will not adversely affect the harmony between
Danville's development and it's physical setting.
BE IT FURTHER RESOLVED THAT the Planning Commission of the Town of Danville
makes the following findings in support of the adoption of the Negative Declaration of
Environmental Significance:
The Negative Declaration prepared fully and adequately addresses potential
environmental impacts associated with this action, satisfying the requirements of
the California Environmental Quality Act (CEQA).
On the basis of the Initial Study of Environmental Impact, there is no evidence that
the project will have a significant effect on the environment.
There is no evidence before the Town that the proposed project will have any
potential for adverse effect on wildlife resources.
