A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF DANVILLE
APPROVING LAND USE PERMIT LUP 91-18 ALLOWING ON-
SITE DISPLAY AND SALES OF AUTOMOBILES
WHEREAS, Robert Hill and Suzy Uffens has requested approval of a Land Use Permit to
allow on-site display and sales of automobiles; and
WHERF~S, the subject site is located on the southwest corner of San Ramon Valley
Boulevard and Estates Drive, at 551 San Ramon Valley Boulevard, and is identified as
Assessor's Parcel Number 208-044-012; and
WHEREAS, the Town of Danville Downtown Masterplan - District 4; Residential Serving
Commercial, requires approval of a Land Use Permit for auto sales; and
WHEREAS, the Planning Commission did review the project at a noticed public hearing
on July 9, 1991; and
WHEREAS, the public notice of this action was given in all respects as required by law;
and
WHEREAS, a staff report was submitted recommending that Planning Commission
approve the request; and
WHEREAS, the Planning Commission did hear and consider all reports,
recommendations, and testimony submitted in writing and presented at the hearing;
NOW, THEREFORE, BE IT RESOLVED THAT the Planning Commission of the Town of
Danville approves the Land Use Permit request, and makes the following findings in
support of the Land Use Permit:
The use will not be detrimental to the health, safety, and general welfare of the
Town.
The use will not adversel~ affect the preservation of property values and the
preservation of the tax base within the Town.

The use will not adversely affect the policy and gOals as set by the General Plan
and the Downtown Business District.
4. The use will not create a nuisance and/or enforcement problem within the district.
CONDITIONS OF APPROVAL
Unless otherwise specified, compliance with the following conditions shall occur within
60 days of the effective date of this permit. Each item is subject to review and approval
by the Planning Division unless otherwise specified.
GENERAL
This approval is for a wholesale and retail car sales operation which would
be operated at 551 San Ramon Valley Boulevard, further identified as
Assessor's Parcel Number 208-044-012. The authorized land use (outdoor
car sales) shall be as shown on the site plan labeled "Exhibit D, Staff Study",
and as conditioned herein.
The developer shall pay any and all Town and other related fees that the
property may be subject to. These fees shall be based on the current fee
schedule in effect at the time the relevant permits are secured.
The display and sale of cars at the northeast corner of the site shall be
limited to a maximum of two vehicles at one time, and shall be contained
within designated stalls to be painted generally as shown on the
aforementioned plans. The final location and design of the stalls and the
entire corner area shall be reviewed and approved by the Design Review
Board prior to construction. The type of vehicles shall be limited to
passenger cars and non-commercial pick-ups or vans. If a pick-up or van is
displayed, it shall be kept within the inside stall to further prevent site
obstruction at the corner, and only one such vehicle may be displayed at a
given time. The stalls shall maintain an appropriate setback from the
property line to allow sufficient sight distance for vehicles pulling out onto
San Ramon Valley Blvd. from Estates Drive, and to allow sufficient area for
pedestrian traffic (see Exhibit D).
The storage of cars in the fenced encloSure at the west side (rear) of the site
shall be limited to a maximum of 8 vehicles at one time. Cars to be sold
shall not be stored on the outside of the fence along Estates Drive.

Customer inspection of cars shall be limited to the following days and hours
to avoid conflicts with the business operations of Danville Auto Parts and
with school related pedestrian traffic:
Monday through friday
Saturday
Sunday
-6:00 p.m.'to 8:00 p.m.
-5:00 p.m, to 8:00 p.m.
-5:00 p.m. to 8:00 p.m.

Signage indicating that individual vehicles are for sale shall be limited to use
of 16" x 24" placecards, one maximum for each vehicle, to be installed in
the front windshield or side window of each vehicle.

Cars shall not be test ~lriven in the residential area to the west of San Ramon
Valley Boulevard.
Proof of sufficient automobile liability insurance shall be submitted to the
Town Planning Division prior to establishment of the land use.
SITE PLANNING
Although no new lighting is proposed in association with this permit, any
future new lighting on the site shall be installed in such a manner that glare
is directed away from surrounding properties and right of ways, and shall
be submitted for review and approval by the Planning Division prior to
installation.
A no parking zone within the sight distance triangle at the corner shall be
established on the pavement general as indicated on Exhibit D. The final
design shall be submitted for review and approval by the Design Review
Board prior to establ, ishment.
The applicant shall construct an eight foot fence along the western (rear)
property boundary, extending the existing wood fence at the rear of the
adjoining parcel (to the south) to within 15 feet of Estates Drive. Details of
the fence shall be submitted for review and approval Design Review Board
prior to construction.

~'~ C. LANDSCAPING
Landscaping installed in a minimum of six landscape pots shall be
established and maintained at the north and east sides of the front display
and sale area. The size of pots, their location and the selection of planting
materials utilized shall be subject to review and approval by the Planning
Division.
D. ARCHITECTURE

All trash and refuse shall be contained within an enclosure that is
architecturally compatible with the main structure. The enclosure shall be
a minimum of 6 feet high with a self closing and self latching gate. The
design of the trash enclosure shall be submitted for reviewed and approved
by the Design Review Board prior to construction. A building permit shall
be obtained from the Town Building Division prior to construction.
The street number of the building shall be posted so as to be easily seen
from the street at all times, day and night.
If signing for the development is desired in addition to any sign approved
as part of this application, a comprehensive sign program shall be submitted
to the Town for consideration under a separate application.
PARKING
The existing parking stalls for this business at the north and east sides of the
building shall be re-striped.
Where authorized, compact car spaces shall be clearly designated with
appropriate pavement marking. Compact car spaces shall be no less than 8
feet by 16 feet in size.
MISCELLANEOUS
This permit author~es the outdoor storage and display of cars, for
wholesale and retail purchase, by the applicant for this permit only. This
permit is not transferable to another business with outdoor storage and/or
display.

Debris and miscellaneous car parts shall be kept inside, in the rear, or
otherwise screened from public view. Car batteries shall be kept within the
newly created screened area near the front entrance, out of public view. No
outdoor repair or dismantling of autos associated with the car sales shall
occure on the site.
This Land Use Permit shall be valid for a period of one year from the
approval date. The land use permit may be extended on a year to year basis
by the Chief of Planning upon verification of continued compatibility with
its surroundings and compliance with Conditions of Approval.
This Land Use Permit may be revoked subject to Section 26-2.202 of the
Municipal Code, including failure to comply with the Conditions of
Approval, or the creation of a nuisance in association with this use.
