RESOLUTION NO. 91-20
A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF DANVILLE
DENYING LAND USE PERMIT LUP 90-27 AUTHORIZING ON-
SITE DISPLAY AND SALE OF AUTOMOBILES
WHEREAS, Robert Hill has requested approval of a Land Use Permit to allow on-site
display and sales of automobiles; and
WHEREAS, the subject site is located on the southwest corner of San Ramon Valley
Boulevard and Estates Drive, at 551 San Ramon Valley Boulevard, and is identified as
Assessor's Parcel Number 208-044-012; and
WHEREAS, the Town of Danville Downtown Masterplan - District 4; Residential Serving
Commercial, requires approval of a Land Use Permit for auto sales; and
WHEREAS, the Planning Commission did review the project at a noticed public hearing
on May 14, 1991; and
WHEREAS, the public notice of this action was given in all respects as required by law;
and
WHEREAS, a staff report was submitted recommending that Planning Commission
approve the request; and
WHERF~S, the Planning Commission did hear and consider all reports,
recommendations, and testimony submitted in writing and presented at the hearing;
NOW, THEREFORE, BE IT RESOLVED THAT the Planning Commission of the Town of
Danville denies the Land Use Permit request, and makes the following findings in support
of the Land Use Permit:
The use will be detrimental to the health, safety, and general welfare of the Town
as the use could create a traffic hazard at the San Ramon Valley and Estates Drive
intersection and on Estates Drive, a main route to Montair School.

The use will adversely affect the preservation of property values and the
preservation of the tax base within the Town.

The use will adversely affect the policy and goals as set by the General Plan and
the DBD District.
5. The use will create a nuisance and/or enforcement problem within the district.
DENIED by the Danville Planning Commission at a Regular Meeting on May 14, 1991,
by the following vote:
