HomeMy WebLinkAbout91-19RESOLUTION NO. 91-19 A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF DANVILLE DENYING A REZONING AND MINOR SUBDMSION REQUEST TO REZONE THE PROPERTY FROM P-l; PLANNED UNIT DEVELOPMENT DISTRICT TO R-40; SINGLE FAMILY RESIDENTIAL DISTRICT AND TO SUBDMDE THE PROPERTY INTO 2 SINGLE FAMILY LOTS WHERF. a~, Elden & Janet Radmall have requested approval of a Rezoning and Minor Subdivision request to Rezone the property from P-l; Planned Unit Development District to R-40; Single Family Residential District and to Subdivide the property into 2 single family lots on a 2.04 acre site; and WHEREAS, the subject site is located at 899 E1 Pintado Road and is identified as Assessor's Parcel Number 200-020-024; and WHE~, the Town of Danville Subdivision Ordinance requires approval of a Tentative Subdivision Map prior to creation of a new lot; and WHEREAS, the item was continued from the Planning Commission meeting of May 14, 1991, at the request of the applicant; and WHEREAS, the Planning Commission did review the project at a noticed public hearing on May 28, 1991; and WHEREAS, the public notice of this action was given in all respects as required by law; and WHEREAS, a staff report was s~bmitted recommending that Planning Commission deny the request; and WHEREAS, the Planning Commission did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; NOW, THEREFORE, BE IT RESOLVED THAT the Planning Commission of the Town of Danville denies the Rezoning and Minor Subdivision request per the findings contained herein: The proposed development is not compatible with, or complementary to, the existing rural residential development pattern in the area. o The proposed lot sizes are inappropriate Country Estate lots due to the sites average slope greater than 15 percent, as specified within the General Plan. The proposed development is not consistent with the previously approved development plan for the area. PAGE I OF RESOLUTION 91-19 Due to the limitations on buildable area and use of the property created by slopes and required setbacks, the proposed development is not consistent with rural estate lots as specified in the General Plan.
