A RESOLUTION OF THE DANVILLE PLANNING COMMISSION DENYING
THE PARK VIEW PROPERTIES PORTION (APN: 207-050-009) OF
GENERAL PLAN AMENDMENT STUDY GPA 89-1 AND
PRELIMINARY DEVELOPMENT PLAN - REZONING REQUEST PUD 89-15
WHEREAS, Park View Properties and Shapell Industries of Northern California sought
approval of a General Plan Amendment and a concurrent Rezoning - Preliminary
Development Plan request involving 23 +/- acres generally located at the south side of
the intersection of Camino Tassajara and Sycamore Valley Road (APN 207-050-009 and
207-050-011); and,
WHEREAS, on February 23, 1989 the Town Council authorized staff preparation of a
General Plan Amendment Study and directed the project proponents to submit a
concurrent Preliminary Development Plan - Rezoning, to detail their preferred land plan
for the Plan Area; and,
WHEREAS, the project proponents sought a General Plan Amendment (GPA 89-1)
reclassifying the subject 23 +/- acres from a Public & Open Space - Parks and Recreation
land use designation to a mixture of Residential - Single Family - Low and/or Medium
Density designation (1-3 and 3-5 dwelling units per acre, respectively) and Public & Open
Space - General Open Space; and
WHEREAS, the concurrent Preliminary Development Plan - Rezoning request (89-15)
sought approval of a 39 unit single family residential Planned Unit Development (original
submittal was 49 units); and,
WHE~, the Planning Commission did review and consider the Proposal at a series of
duly noticed public hearings, concluding with a hearing on April 9, 1991; and,
WHEREAS, a Negative Declaration of Environmental Significance was prepared for the
project pursuant to the regulations of the California Environmental Quality Act (CEQA),
which indicated that no significant environmental impacts were anticipated to be
associated with the development of the site and which called for the preparation of
additional environmental analysis with the subsequent submittal of detailed Tentative
Map/Final Development Plan applications (with said environmental work to have been
based in part on additional studies, including; hydraulic, tree preservation and
soils/geotechnical studies); and,
WHEREAS, the Planning Commission received and considered the reports and
recommendations as submitted by the Town staff, contained in various staff reports
culminating with the report for the April 9, 1991 Planning Commission meeting, wherein
staff recommended approval of the General Plan Amendment Study (GPA 89-1) for the
entire 23 +/- acre Plan Area to a combination of Residential - Single Family - Low Density
(1-3 dwelling units per acre) and Public & Open Space - Public and Semi Public and
recommended denial without prejudice for the Park View Properties portion of the
Preliminary Development Plan - Rezoning request (PUD 89-15) - staff concurrently
recommended approval of the Shapell Industries of Northern California portion of PUD
89-15 (based generally on a re-submittal from Shapell which reduced their proposed lot
count from 27 to 17 lots and incorporated the desired 0.6 +/- acre child care facility);
and,
WHEREAS, the Planning Commission did hear and consider all reports, recommendations
and testimony presented prior to or during the public hearings; and,
WHE~, Park View Properties chose not to submit a revised land plan consistent with
the Commission's generalized direction forwarded at their meetings of August 21, 1990
and February 21, 1991 (which called for a reduction in the density of the project from a
3-5 dwelling unit per acre range to a 1-3 dwelling unit per acre range - as reflected
generally in Shapell's re-submittal - and called for the inclusion of a 0.8 acre equestrian
staging area); and
WHE~, based on the above considerations the Planning Commission finds that the
land plan forwarded by Park View Properties (indicating 22 units and not incorporating
the desired equestrian staging area) cannot be found to be consistent with the goals and
policies of the Danville 2005 General Plan for the following reasons:
The proposed density/land plan fails to provide a site for an equestrian
staging area - an identified public need for the residents of the Sycamore
Valley Specific Plan Area,
The proposed density/land plan fails to account for the development
constraints resulting from the property's relatively long and narrow
buildable areas (i.e., areas located outside of the flood control areas),
The proposed density/land plan fails to address the development constraints
associated with the presence of the East Bay Municipal Utilities District
pumping station facility - which the subject property surrounds,
The proposed density/land plan fails to adequately address the development
constraints related to the presence of moderate to steep slope gradients and
areas of slope failure, and

The proposed density/land plan creates a visual impact to the surrounding
properties (the subject property's visual prominence is a function of the
property's location at the entry to the Sycamore Valley Specific Plan).
NOW, THEREFORE, BE IT RESOLVED THAT the Danville Planning Commission denies
without prejudice the Park View Properties portion of General Plan Amendment Study
GPA 89-1 and Preliminary Development Plan - Rezoning request PUD 89-15.
