RESOLUTION NO. 90-42
A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF DANVILLE
RECOMMENDING THE TOWN COUNCIL APPROVE RZ 90-4, REZONING TWO SITES
LOCATED AT 530 LA GONDA WAY AND 400 EL CERRO BOULEVARD FROM R-15;
SINGLE FAMILY RESIDENTIAL DISTRICT TO 0-1; LIMITED OFFICE
WHEREAS, Oak Creek Re, alty has requested approval of a rezoning request from
R-15; Single Family Residential District to O-1; Limited Office District for two sites located
within the E1 Cerro General Plan Amendment Study Area; and
WHEREAS, one of the subject sites is 1.26 acres, located on the south west corner
of the intersection of E1 Cerro ]Blvd. and West E1 Pintado, at 400 E1 Cerro Blvd. and is
identified as Assessor's Parcel Number 200-140-016; and
WHEREAS, the second site is .77 acres, located on the easterly side of La Gonda
Way, approximately 350 north of E1 Cerro Boulevard, at 530 La Gonda and is identified
as Assessor's Parcel Numbers 200-260-001 through -006; and
WHEREAS, the Planning Commission did review the project at a noticed public
hearing on July 24, 1990; and
WHEREAS, the proper notice of this request was given in all respects as required
by law; and
WHEREAS, a draft Negatiwe Declaration of Environmental Significance was prepared
for the project, indicating that no significant impacts are anticipated to be associated with
this project; and
WHEREAS, a staff report was submitted recommending that Planning Commission
recommend Town Council approval; and
WHEREAS, the Planning Commission did hear and consider all reports,
recommendations, and testimony submitted in writing and presented at the hearing;
NOW, THEREFORE, BE IT RESOLVED THAT the Planning Commission of the Town
of Danville recommends the Town Council grant a Negative Declaration of Environmental
Significance and approve the Rezoning request, and makes the following findings in

support of the Rezoning request RZ 90-4:
The proposed rezoning from R-15; Single Family Residential District to O-1; Limited
Office District is consistent with the Danville 2005 General Plan.
The proposed rezoning will maintain an environment of sustained desirability and
stability and will be in harmony with the character of the surrounding
neighborhood and community.
The uses authorized under this rezoning action are compatible within the 0-1;
Limited Office District and to uses authorized in adjacent residentially zoned
districts.
