A RESOLUTION OF THE PL3dNNING COMMISSION OF THE TOWN OF DANVILLE
APPROVING A REQUEST TO AMEND CONDITIONS OF APPROVAL
FOR PUD 89-06 & SD 7335 '
WHEREAS, Town Council[ approved PUD 89-6 & SD 7335 for a 47 lot custom single
family subdivision on December 18, 1989; and
WHEREAS, Signature Properties has requested approval to amend condition D.6.
of Conditions of Approval for PUD 89-06 & SD 7335 to allow building heights to exceed
28 feet; and
WHEREAS, the subject site is located on the west side of Old Blackhawk Road,
approximately one-half mile north of Camino Tassajara and is identified as Assessor's
Parcel Number 215-100-009; and
WHEREAS, the Planning ,Commission did review the project at a noticed public
hearing on July 10, 1990; and
WHEREAS, the proper notice of this request was given in all respects as required
by law; and
WHEREAS, a staff report was submitted recommending that: Planning Commission
approve the request; and
WHEREAS, the Planning Commission did hear and consider all reports,
recommendations, and testimony submitted in writing and presented at the hearing;
NOW, THEREFORE, BE IT RESOLVED THAT the Planning Commission of the Town
of Danville approves the proposed amendment per the conditions contained herein, and
makes the following findings in support of the amendment:
The proposed 35 fbot height limit for the single family sn'uctures located within
PUD 89-06 is consistent with the Danville 2005 General Plan.

The proposed 35 foot height limit is in substantial confOrmance with the P-l;
Planned Unit Development District.
3. The proposed 35 foot height limit will not cause significant environmental damage

or substantially and voidable injure fish, wildlife or their habitat.
The proposed 35 foot height limit will not likely cause serious public health
problems.
The subdivision site is physically suitable to accomodate: residences 35 feet in
height.
CONDITIONS OF APPROVAL
The maximum building height for Lots 1-6, 15-22, 23-27 & 31-47 shall be a
maximum of 35 feet measured from average grade. Any area projecting above the
28 foot building height plane shall be uninhabitable and shall riot exceed 15% of
the building foot print. No major roof lines shall exceed 28 feet measured from
average grade.
The maximum building height for Lots 7-14 and 28-30 is :28 feet measured from
average grade; however,, uninhabitable minor architectural features such as
dormers, towers and chimneys may be constructed as high as 35 feet measured
from average grade. No major rooflines shall exceed 28 feet measured from
average grade.
APPROVED by the Danville Planning Commission at a Regular Meeting on July 10, 1990
by the following vote:
