HomeMy WebLinkAbout90-34RESOLUTION NO. 90-34 A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF DANVILLE DETERMINING THE GENERAL PLAN CONFORMITY FOR THE SALE OF 0.0762 ACRES OF REAL PROPERTY ABUTTING THE NORTHERLY SIDE OF SAN RAMON CREEK NORTHEASTERLY OF OSAGE PARK (A PORTION OF APN 207-080-029) WHEREAS, Government Code Title 7, Division 1, Chapter 3, Article 7, Subsection 65402, requires that where a General Plan has been adopted, the Planning Agency has the responsibility as to determination of General Plan conformity prior to any sale of public land; and WHEREAS, The Town of Danville does have an approved and adopted General Plan; and WHEREAS, Victor Conti has requested and offered to purchase from the Town that real property attached hereto as a Grant Deed; and WHEREAS, the staff report by the Engineering department states that said real property is not necessary for current or prospective public use; and WHEREAS, it is in the interests of the Town to sell such unnecessary land thereby relieving itself of excess land, potential liabilities and reducing maintenance costs; now, therefore, BE IT RESOLVED, the Planning Commission of the Town of Danville that the sale of hereinabove real property is in conformity with the adopted General Plan of the Town of Danville; and be it FURTHER RESOLVED, the Planning Commission does hereby recommend to the Town Council, the sale of the hereinabove real property. APPROVED by the Planning Commission of the Town of Danville on this 12th day of June, 1990, by the following vote: AYES: Hughes, Frost, Hendricks, Wright, Hunt, Hirsch NOES: ABSTAINED: ABSENT: Vilhauer CHAIRMAN pmzz2
