HomeMy WebLinkAbout90-30RESOLUTION NO. 30-90 A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF DANVILLE DETERMINING GENERAL PLAN CONFORMITY FOR THE ACQUISITION OF 1.646 ACRES OF REAL PROPERTY ON THE NORTH SIDE OF FOSTORIA EAST OF HIGHWAY 680 (APN 218-090-010) WHEREAS, Government Code Section 65402 requires that where a General Plan has been adopted, the Planning Agency has the responsibility as to determination of General Plan conformity; and WHEREAS, The Town of Danville does have an approved and adopted General Plan; and WHEREAS, Castle ConStruction was required per an agreement dated December 19, 1986 with the Town of Danville to convey certain real property to the Town; and WHEREAS, Fostoria Associates, Ltd. (affiliated with Castle Construction) has offered to the Town that certain real property conveyed by Grant Deed dated July 22, 1988 and contained in the staff report to this commission dated May 22, 1990; and WHEREAS, the conveyance of said real property satisfies said agreement; and WHEREAS, the acceptance of said real property satisfies said agreement and is in the interests of the Town of Danville; now, therefore, be it RESOLVED, by the Planning Commission of the Town of Danville that: 1. The acceptance of that real property conveyed to the Town of Danville by Fostoria Associates, Ltd. dated July 22, 1988 is in conformity with the adopted General Plan of the Town of Danville; 2. Acceptance of said real property is recommended to the Town Council. APPROVED by the Danville Town Planning Commission at a regular meeting on May 22 , 1990 by the following vote: AYES: NOES: ABSTAINED: ABSENT: Vilhauer, Hughes, Hendricks, Wright, Hunt, Hirsch Frost ChieT/o~ Planning E: ~plannin~z Chairman
