HomeMy WebLinkAbout90-17RESOLUTION NO. 90-17 A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF DANVILLE APPROVING A LAND USE PERMIT FOR A MUNICIPAL SERVICE CENTER FOR THE TOWN OF DANVILLE & CENTRAL CONTRA COSTA SANITARY DISTRICT WHERF~S, the Town of Danville has requested approval of a Land Use Permit for a Municipal Service Center on a 6.9 acre site which will serve the Town of Danville and Central Contra Costa Sanitary District; and WHEREAS, the subject site is zoned P-l; Planned Unit Development District and is located immediately north of the existing U.S. Post Office (2605 Camino Tassajara), which is situated at the northwest corner of the intersection of Sherburne Hills Road and Camino Tassajara; and WHEREAS, the P-1 District requires a land use permit for a Municipal Service Center; and WHEREAS, the Danville Town Council adopted a Mitigated Negative Declaration of Environmental Significance for the Municipal Service Center on November 20, 1989; and WHEREAS, the proper notice of the land use permit request was given in all respects as required by law; and WHEREAS, a staff report was submitted recommending that the Planning Commission approve the request; and WHEREAS, the Planning Commission did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; NOW, THEREFORE, BE IT RESOLVED THAT the Planning Commission of the Town of Danville recommends approval of the land use permit request per the conditions contained herein, and makes the following findings in support of the land use permit: The proposed Municipal Service Center will not be detrimental to the health, safety and general welfare of the Town; The proposed Municipal Service Center will not adversely affect the orderly development of property within the Town; The proposed Municipal Service Center will not adversely affect the preservation of property values and the protection of the tax base within the Town; Page 1 of Resolution No. 90-17 The proposed Municipal Service Center and real property aquisitions or dispositions are consistent with the policies and goals of the Danville 2005 General Plan and will not adversely impact the Town; The proposed Municipal Service Center will not create a nuisance and/or enforcement problem within the neighborhood or community; The Municipal Service Center will be in harmony with the character of the surrounding neighborhood and community and will not encourage marginal development within the neighborhood and community; Special conditions and unique characteristics of the subject property and its location or surroundings exist, warranting approval of the land use permit request to establish the Municipal Service Center. The design and improvements of the proposed Municipal Service Center will not cause substantial environmental damage or substantially and avoidably injure fish or wildlife. Project conditions will serve to mitigate potential significant environmental impacts identified in the Mitigated Negative Declaration of Environmental Significance prepared for this project (see asteriked conditions below). CONDITIONS OF APPROVAL Unless otherwise specified, the following Conditions shall be complied with prior to completion of the project. Each item is subject to review and approval by the Planning Department unless otherwise specified. A. GENERAL This approval is for a Municipal Service Center on 6.9 acres which will serve the Town of Danville and ultimately Central Contra Costa Sanitary District (CCCSD). The subject site is identified as Assessor Parcel Number 215-090-023. Development shall be substantially as shown on the project drawings as follows, except as may be modified by conditions contained herein; ao Final Site Plan prepared by Black & Veatch and dated March 19, 1990 bo Architectural Plan for Municipal Service Center prepared by Kimbrell Associates and dated March 19, 1990. If archeological materials are uncovered during any construction or pre-construction activities on the site, all earthwork within 100 feet of these materials shall be stopped, the Town Planning Department notified, and Page 2 of Resolution No. 90-1.7 a professional archeologist, certified by the Society of California Archeology and/or the Society of Professional Archeology, shall be notified. Site work in this area shall not occur until the archeologist has had an opportunity to evaluate the significance of the find and to outline appropriate mitigation measures, if they are deemed necessary. Construction operations, delivery of construction materials, and warming up of grading and construction equipment shall be limited to weekdays (Mondays through Fridays) during the hours from 7:30 a.m. to 5:30 p.m., unless otherwise approved in writing by the City Engineer. Said extension of work hours shall take particular attention to noise impacts related to the project's construction. Site preparation work shall be done as expeditiously as possible to minimize time spent using loud earthmoving equipment. All construction equipment shall utilize required manufacturer's noise attention shielding devices and engine intake exhaust mufflers. If determined necessary by the City Engineer, the project developer shall provide security fencing around the entire site during construction of the project. SITE PLANNING All exterior building and yard lighting shall be designed and installed to effectively achieve goals of safety and security while using minimal number of light standards and hours of lighting where necessary. Lighting shall incorporate appropriate lamp shields to direct light, to the extent reasonable, downward to sidewalks, paths, parking areas, and within the yard. All lighting shall be installed in such a manner that glare is directed away from surrounding properties and rights-of-way. o The location of any pad mounted transformers shall be effectively screened from the public view. LANDSCAPING Final Landscape and Irrigation Plans (with planting shown at 1"= 20' scale) shall be submitted for review and approval by the Planning Department. All plant material shall be served by an automatic underground irrigation system and maintained in a healthy growing condition. All trees shall be a minimum of 15 gallon container size and properly staked. Shrubs not used as ground cover shall be a minimum of 5 gallons is size. Page 3 of Resolution No. 90-17 Do All landscaped areas not covered by shrubs and trees shall be planted with live ground cover. Landscaping for the project shall be established to soften the views of the maintenance buildings visible to neighboring residents, land uses and motorists driving along Camino Tassajara. Landscaping for the project shall utilize native landscape species to the extent possible and select species which provide sufficient height and massing to soften views of project structures and which provide food and cover for wildlife. ARCHITECTURE All ducts, meters, air conditioning and/or any other mechanical equipment whether on the structure or on the ground shall be effectively screened from view with landscaping or materials architecturally compatible with the main structure(s). The highest point of any roof mounted equipment shall not extend above the top of the equipment well. All trash and refuse shall be contained within enclosures architecturally compatible with the main structure(s). Enclosure design shall include six (6) foot high masonry walls on three sides with steel framed gates and wood bolted to the gates. Gates will be self-closing and self-latching. If signing for the development is desired, in addition to any signs approved as part of this application, a comprehensive sign program shall be submitted and is subject to review and approval of the Chief of Planning prior to installation. All permanent structures on the CCCSD site shall require review and approval of the Design Review Board in addition to Development Plan approval by the Planning Commission prior to construction. All CCCSD structures shall be consistent with the architecture of buildings located on the Municipal Service Center site. Building materials, roof lines and colors of such structures shall be consistent with the Town of Danville structures on the Municipal Service Center site. All structures to be constructed on the CCCSD site shall be limited to one story and a maximum height of 20 feet. Prior to the issuance of a building permit, samples of final colors and materials selected shall be submitted to the Planning Department for review and approval. Page 4 of Resolution No. 90-17 Fo ° Temporary modular units for use by Town employees may be placed on the eastern parking area until the permanent facilities are established. The precise citing and exterior finish of these units shall be subject to review and approval by the Chief of Planning. A temporary modular office, and ancillary storage facilities, for use by CCCSD employees may be placed on the CCCSD site for a maximum period of two years. (This time limit may be extended for up to two additional years by the Chief of Planning upon his determination of continued need and observance of the above stated Findings of Approval.) The precise citing and exterior finish of the modular office shall be subject to review and approval by the Chief of Planning prior to issuance of building permits. 10.* Buildings shall be constructed with exterior wood siding and have exterior colors which will complement the natural environment. 11.* Earthen landscaped berms shall be provided around the perimeter of the site to soften the views of the maintenance buildings visible to neighboring residents, and motorists driving along Camino Tassajara. 12. The portico at the entrance of the Town administration building shall be redesigned and is subject to approval of the Design Review Board. PARKING All parking spaces shall be striped and provided with wheel stops unless they are fronted by concrete curbs, in which case sufficient areas shall be provided beyond the ends of all parking spaces to accommodate the overhang of automobiles. Where authorized, compact car spaces shall be clearly designated with appropriate pavement marking or signage. Compact spaces shall be no less than 8 feet by 16 feet in size including allowable overhang. GRADING Any grading on adjacent properties will require submittal of documentation of written approval of those property owners affected. ° Areas undergoing grading, and all other construction activities shall be watered, or treated with other dust control measures to prevent dust. These measures shall be approved by the Chief Building Official and employed at all times as conditions warrant. All earthwork shall be conducted using the recommendations in the Berlogger Geotechnical Consultants Reports for Tassajara t'ark, dated July Page 5 of Resolution No. 90-17 6, 1988 and August 8, 1989. This includes the recommendation that a field representative of a contracted geotechnical firm should be present during all site clearing and grading operations to test and observe all earthwork construction, including site preparation and grading, utility trench backfilling, and roadway subgrade compaction. The field representative shall also be present to evaluate the condition of cut slopes; and to recommend final buttress and shear keyway configurations; and to select the final locations for all subdrains. The recommendations of the August, 1989 report are contingent upon these field observation provisions. Additionally, the contracted geotechnical firm shall be notified at least 48 hours prior to commencement of any grading activity to allow for discussion and planning with the earthwork contractor, in order to minimize possible misunderstandings and to avoid unnecessary delays. Structures shall be designed according to the current Uniform Building Code for Seismic Zone 4 (those areas where the potential for major structural damage from earthquakes exists). Cut slope design shall be conservative to minimize the potential for slope failure. Foundation design for structures shall be designed to have minimal support contact with soil in the zone of seasonal moisture changes. (Drilled piers deriving their support below the zone of seasonal moisture change is an example of the type of foundation meeting this criteria.) Roads and other pavements shall be designed to minimize effects from expansion pressures. Flexible asphaltic materials may be used rather than rigid concrete slabs. Where soils or geologic conditions encountered in grading operations are different from that anticipated in the soil report, a revised soils report shall be submitted for review and approval by the Town Engineer. It shall be accompanied by an engineering and geological opinion as to the safety of the site from settlement and seismic activity. STREETS Any damage to street improvements now existing or done during construction on or adjacent to the subject property shall be repaired to the satisfaction of the City Engineer at full expense to the developer. This shall include slurry seal, overlay or street reconstruction if deemed warranted by the City Engineer. Handicapped ramps shall be provided and located as required by the City Engineer. Page 6 of Resolution No. 90-17 All improvements within the public right-of-way, including curb, gutter, sidewalks, driveways, paving and utilities, shall be constructed in accordance with approved standards and/or plans and shall comply with the standards established in Title 9 of the City Code. INFRASTRUCTURE Water supply service shall be provided by the East Bay Municipal Utility District in accordance with the requirements of the District. Sewer disposal service shall be provided by the Central Contra Costa Sanitary District in accordance with the requirements of the District. Drainage facilities and easements shall be provided to the satisfaction of the City Engineer and/or the Chief Engineer of the Contra Costa County Flood Control District. Ail storm water run-off shall be collected and conducted via an approved drainage method to the nearest approved downstream facility. All drainage facilities on-site shall be designed to accommodate a 100 year design storm for the area. o Off-site drainage flows shall be intercepted at the project boundary via an approved storm drain facility, or as approved by the City. Roof drains shall empty onto paved areas, concrete swales, other approved dissipating devices, or into a pipe. Concentrated drainage flows shall not be permitted to cross sidewalks or driveways. Any portion of the drainage system that conveys runoff from public streets shall be installed within a dedicated drainage easement, or public street. 0 The developer shall comply with all relevant requirements of the Contra Costa County Flood Control District and the Department of Fish and Game. 10. All utilities required to serve the development shall be installed underground. 11. Ail public improvement plans shall be prepared by a licensed civil engineer. MISCELLANEOUS 1. The project shall be constructed as approved. Minor modifications in the design, but not the use, may be approved hy Staff. Any other change will Page 7 of Resolution No. 90-17 require Planning Commission approval through the Development Plan review process. Use of the Town of Danville portion of the Municipal Service Center shall include: Administration building with office and locker facilities for streets, parks, engineering, and building maintenance employees. b. Covered parking for motorized and other maintenance equipment. An operations building for vehicle and equipment maintenance, street sign production, carpentry and fabrication activities. d. A warehouse and police impound yard. e. Covered parking for Town vehicles. f. A fuel station and large trash enclosure. go Other use similar or ancillary to the above uses, as deemed appropriate by the Town Manager. 3. Uses of the CCCSD site shall include: a. Office/personnel facilities b. Parking c. Support facilities 1. fuel pumps 2. vehicle wash-down area 3. vehicle maintenance shop 4. covered warehouse 5. spoils storage (no sewage spoils) 6. uncovered storage of vehicles, sewer piping and associated fittings 7. gravel, rock and material bins 8. other uses of a similar nature as approved by staff d. Other uses of the CCCSD site may be permitted subject to approval of a Development Plan by the Planning Commission. A Parcel Map shall be prepared and processed for the sale of the proposed one acre site to CCCSD. A majority of incoming and outgoing traffic to the site shall use the signalized Sherburne Hills entrance. The Tassajara Lane entrance/exit for the site shall be utilized only infrequently, and such traffic shall not conflict Page 8 of Resolution No. 90-17 o 10. with traffic associated with the Learning Center or the Messiah Lutheran Church. If the Tassajara Lane entrance/exit is to be used as more than a secondary access, additional review and approval will be required by the Chief of Planning. The developer shall conform to all requirements of San Ramon Valley Fire Protection District (see March 4, 1990 letter). All requirements set forth in Contra Costa County Health Services Department Environmental Health Division's February 13, 1990 letter shall be met. The Town shall pay a proportionate share of the costs to signalize the traffic signal at Camino Tassajara and Sherburne Hills. Storage of hazardous materials, such as paints, solvents, and pesticides shall be stored according to the regulations of Contra Costa County. The underground gasoline tank shall also be regulated according to the specifications of Contra Costa County. All buildings on the site, including the CCCSD site, shall be maintained in a neat and clean manner, free of trash and debris. At the of review of the required CCCSD permit, the Chief of Planning shall review the quality of maintenance for the entire site and at that time any needs shall be addressed and implemented.
