HomeMy WebLinkAbout90-06 RESOLUTION NO. 90-6 A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF DANVILLE APPROVING DEVELOPMENT PLAN REQUEST DP 90-6 FOR AN AMENDMENT TO THE INTERNATIONAL VILLAGE SHOPPING CENTER LIGHTING PROGRAM WHEREAS, Norman Alumbaugh has requested approval of a Development Plan to modify the lighting program at the International Village Shopping Center; and WHEREAS, the subject site is located at 103-J Town and Country Drive; and WHEREAS, the Town of Danville Ordinance 135 requires approval of a Development Plan for all development in Area 7 - Retail; and WHEREAS, the Planning Commission did review the project at a noticed public hearing on February 13, 1990; and WHEREAS, the proper notice of this request was given in all respects as required by law; and WHEREAS, a staff report was submitted recommending that Planning Commission approve the request; and WHEREAS, the proposed project is exempt from the provisions of the California Environmental Quality Act; and WHEREAS, the Planning Commission did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; NOW, THEREFORE, BE IT RESOLVED THAT the Planning Commission of the Town of Danville approves the Development Plan DP 90-6 per the conditions contained herein, and makes the following findings in support of the Development Plan: 1. The proposed development is consistent with Downtown Master Plan. 2. The proposed development will serve to establish a retail environment of sustained desirability and will be in harmony with the character of the surrounding neighborhood and community. The proposed development will have no off-site traffic and drainage impacts. the Downtown Business District Ordinance 135 o 4. The development is consistent with requirements for Area 7: Retail. CONDITIONS OF APPROVAL Unless otherwise specified, the following Conditions shall be complied with prior to issuance of a building permit for the project. Each item is subject to review and approval by the Planning Division unless otherwise specified. This approval amends the lighting plan for DP 87-1 International Village Shopping Center. All remainder development on the site shall be governed by the Conditions of Approval for PAGE 1 OF RESOLUTION NO. 90-6 DP 87-1 and VAR 87-2. The site is identified as Assessor Parcel Number 208-060-053-5. Development shall be substantially as shown on the project drawings received by the Planning Department February 1, 1990. The developer shall pay any and all Town and other related fees that the property may be subject to. These fees shall be based on the current fee schedule in effect at the time the relevant permits are secured. All lighting shall be installed and maintained in such a manner that glare is directed away from surrounding properties and rights-of-way. The location of any newly installed pad mounted transformers shall be subject to approval by the Planning Division prior to the issuance of a building permit. Generally speaking, such transformers shall not be located between any street and the front of a building. The project shall be constructed as approved. Any other change will require Planning Commission approval through the Development Plan review process. The developer shall eliminate, replace or devise a lighting system to screen the off-site glare created by the existing light fixtures located underneath the roof eave of Building A to the satisfaction of the Planning Department within one year of this approval.
