CONDITIONS OF APPROVAL
LUP 88-16
FINDINGS
The use will not be determinal to the health, safety and
general welfare of the Town.
The use will not adversely affect the orderly development of
property within the Town.
The use will not adversely affect the preservation of
property values and the protection of the tax base within
the Town.
The use will not adversely affect the policy and goals as
set by the General Plan.
The use will not create a nuisance and/or enforcement
problem within the neighborhood.
The use will not encourage marginal development in the
neighborhood.
CONDITIONS OF APPROVAL
The placement and size of the whip antenna shall be
substantially as shown on the project drawings and as
described in the written statement, collectively submitted
with the application and dated September 19, 1988.
The applicant/owner shall pay any and all Town and other
related fees that the property may be subject to. These
fees shall be based on the current fee schedule in effect at
the time the relevant permit is secured.
Construction operations shall be limited to weekdays (Monday
through Friday) during the hours from 7:30 a.m. to 5:30
p.m., unless otherwise approved in writing by the City
Engineer.
Operation of the whip antenna shall be controlled so as not
to create a nuisance to the adjoining residential
neighborhood.
Prior to the radio transmitting use, the applicant shall
provide subject documentation to the Town that Federal
Communications Commission approval has been received for
this use and the proposed radio frequency of the radio
transmitter.
Any expansion or modification in the use of the antenna
shall be subject to review under a separate Land Use Permit
application.
