Conditions of Approval
LUP 88-5 'i<
FINDINGS
The use will not be detrimental to the health, safety and
general welfare of the Town.
The use will not adversely affect the orderly development of
property within the Town as Ordinance #24-83 allows the
construction of a second dwelling unit on a single parcel
subject to issuance of a Land Use Permit.
The use will not adversely affect the preservation of
property values and the protection of the tax base within
the Town.
The use will not adversely affect the policy and goals as
set by the General Plan.

The use will not create a nuisance and/or enforcement
problem within the neighborhood.
The use will not encourage marginal development in the
neighborhood as this unit is compatible in quality and
design with other residences in the neighborhood.
CONDITIONS OF APPROVAL
A. General
Except as may be modified by the following conditions,
development of the second dwelling unit shall be
substantially as shown on the project drawings labeled
"Revised apartment addition to Joyce Harris residence,"
as prepared by Karen S. Robinson CE, and dated received
by the Planning Department on June 17, 1988.
The developer shall pay any and all city and other
related fees that the property may be subject to.
These fees shall be based on the current fee schedule
in effect at the time the relevant permit is secured.
Notice should be taken specifically of the City's
Transportation Improvement Program Fee (TIP) and the
Park Dedication Fee.
Prior to issuance of a building permit the applicant
shall supply written confirmation that all requirements
of the San Ramon Valley Fire Protection District and
the San Ramon Valley Unified School District have been
satisfied.
Prior to issuance of a building permit the applicant
shall supply written confirmation that all the
requirements of the Contra Costa County Flood Control
have been satisfied.
If archeological materials are uncovered during any
construction or pre-construction activities on the
site, all earthwork within 100 feet of these materials
shall be stopped until a professional archeologist
certified by the Society of California Archeology
and/or the Society of Professional Archeology has an
opportunity to evaluate the significance of the find
and to suggest appropriate mitigation measures, if they
are deemed necessary·

Construction and grading operations shall be limited to
weekdays (Mondays through Fridays) during the hours
from 7:30 a.m. to 5:30 p.m., unless otherwise approved
in writing by the City Engineer.
The property owner shall occupy either the primary or
the secondary residential unit. If neither unit is
owner-occupied, then the second unit shall~be
physically modified to serve only as accessory living
space for the primary unit. The owner shall record a
deed restriction setting forth this occupancy
requirement prior to the issuance of a building
permit. The deed restriction shall also serve to
preclude use of the living room as a second bedroom.
Nothing in this condition shall be construed to
prohibit one or both of the units remaining vacant.
The deed restriction shall be submitted for review and
approval by the Planning Department and the City
Attorney prior to recordation.
Site Planninq
Ail new lighting shall be installed in such a manner
that the light source shall not be visible from
surrounding properties and rights-of-way.
The location of any new pad transformers shall be
subject to approval by the Planning Department prior to
the issuance of a building permit. Generally
speaking, such transformers shall not be located
between any street and the front of any building.
The 10 x 21 foot paved area labeled as "off street
parking" shall be deleted on the working drawings.
A 9 x 19 foot parking space shall be provided in the
existing garage structure.
C. Landscaping
Existing trees on the site shall be preserved to the
greatest extent practicable. Removal will be allowed
only upon receipt of written approval from the Planning
Department.
D. Architecture

Ail new ducts meters, air conditioning and/or any other
mechanical equipment whether on the structure or on the
ground shall be effectively screened from view with
landscaping or materials architecturally compatible
with the main structure(s).
The street numbers of both units shall be posted so as
to be easily seen from the access road at all times,
day and night.
Final colors and materials have been approved, as
follows:
Body Color - Tamarino Q8 - 12T
Trim Color - Empire Green Q8 - 14D
Any change will require review and approval by the
Planning Department.
Grading
Any grading on adjacent properties will require written
approval of those property owners affected.
Areas undergoing grading, and all other construction
activities shall be watered, or treated with other dust
control measures to prevent dust. These measures shall
be approved by the City Engineer and employed at all
times as conditions warrant.
Streets
The applicant shall obtain an encroachment permit from
the Engineering Department prior to commencing any
construction activities within any public right-of-way
or easement.
The applicant shall keep adjoining public streets free
and clean of project dirt, mud, materials and debris
during the construction period, as is found necessary
by the City Engineer.
Approximately 15 linear feet of the existing hedge
adjacent to the driveway shall be removed to eliminate
a sight distance problem area. This shall be
accomplished prior to occupancy of the second unit.
Any damage to street improvements now existing or done
during construction on or adjacent to the subject
property shall be repaired to the satisfaction of the
City Engineer at full expense to the Applicant. This
shall include slurry seal, overlay or street
reconstruction if deemed warranted by the City
Engineer.
G. Drainaqe and Infrastructure
Water supply service shall be provided by the East Bay
Municipal Utility District in accordance with the
requirements of the District.
Sewer disposal service shall be provided by the Central
Contra Costa Sanitary District in accordance with the
requirements of the District.
Ail storm water run-off shall be collected and
conducted via an approved drainage method to the
project boundary via an approved storm drain facility,
or as approved by the City Engineer.
Roof drains shall empty onto paved areas, concrete
swales, other approved dissipating devises, or into a
pipe.

Concentrated drainage flows shall not be permitted to
cross sidewalks or driveways.
Ail utilities required to serve the development shall
be installed underground.
Prior to issuance of a building permit, applicant shall
submit drainage improvement plan for review and
approval by the City Engineer. The plan shall provide
a means of collecting all new impervious surface
drainage and all surface drainage and all surface
drainage intercepted by the proposed building. The
plan shall also provide a means of carrying said water
to a public facility or an existing acceptable private
drainage way.
