HomeMy WebLinkAboutLUP 87-09 Exhibit A FINDINGS AND CONDITIONS OF APPROVAL Holbrook - LUP 87-9 FINDINGS The Planning Commission has determined that the following findings exist in support of the proposed land use: The livestock feedstore will not be detrimental to the health, safety and general welfare of the Town; The livestock feedstore will not adversely affect the orderly development of property within the Town; The livestock feedstore is consistent with the policies and goals as set by the general plan; The livestock feedstore will not create a nuisance or enforcement problem within the neighborhood and will not encourage marginal development; Se The livestock feedstore, with the attached Conditions of Approval, is consistent with town of Danville Zoning Ordinance Section 84-38.404. The realignment of the feedstore driveway, as conditioned to align with the Meadow Creek entrance conforms with the Sycamore Valley Access Control Circulation Plan. CONDITIONS OF APPROVAL Except as may be modified by the following conditions, operation of the feedstore facility shall be substantially as shown on the project drawings labeled LUP 87-9 dated June 12, 1987. The approval is for a livestock feed supply operation and shall not include sale of small hardware items, typical household pet supplies, small pets, or other small retail items not typically found at a ranch-type feed and supply operation. The developer shall pay any and all Town and other related fees that the property may be subject to. These fees shall be based on the current fee schedule in effect at the time the relevant permit is secured. One sign is allowed with this permit for purposes of identification. The sign shall be limited to a maximum area of 15 square feet and a height of not more than 3 feet. The location of the sign shall be subject to review and approval by the Planning Department. lC 10. 11. 12. A minimum of one parking space for each 500 square feet of gross floor area shall be provided. Parking areas shall be gravelled or paved. The permit is granted for a feed supply operation only. Exterior lighting shall be of a non-glare nature and shall be deflected away from adjacent properties. Ail new utility distribution services shall be installed underground. Any outdoor storage associated with the feed supply operation shall be screened from view from Camino Tassaj ara. The applicant shall enter into a deferred improvement agreement with the Town within ninety (90) days from the date of the approval of this Land Use Permit. Said agreement shall serve to assure installation of the landscaping along the frontage of the subject parcel in conformance with the Camino Tassajara Streetscape Design Guidelines. Improvements shall include two 6 foot wide concrete sidewalks located within a 3:1 slope. The installation of the landscaping shall be required upon completion of frontage landscaping improvements on the properties immediately adjacent to the applicant's property. Failure to enter into a deferred improvement agreement with the Town or failure to install the landscaping within the time frame outlined in this condition shall be cause for the revocation of this Land Use Permit. The applicant shall within six months from the date of approval of this Land Use Permit, prepare plans for review and approval by the Planning Department and Engineering Department for realignment of a 20 foot wide paved access drive to align with the westerly edge of the Meadow Creek entrance. The existing 25 foot easement along the eastern edge of the property shall also be realigned to conform with the Sycamore Valley Access Control Circulation Plan. Failure to comply with this condition shall be cause for revocation of this Land Use Permit. Ail store deliveries shall be made during store hours (9-6 p.m. Monday through Friday & 9-5 p.m. Saturday). Upon approval of a rezoning application for the site, which does not permit a feedstore use in the zoning district, the use becomes a legal non-conforming use and the use cannot be expanded. 13. Upon recordation of a Final Map for the 4.6+ acre subject property (APN: 215-090-011), this Land Use Permit ceases and becomes null and void. 14. This permit shall be revocable for cause in accordance with Section 26-2.2022 of the Zoning Ordinance. 15. The land use shall be subject to administrative review by the Planning Department at the third anniversary of the permit (October 7, 1988) to verify that the Conditions remain adequate to assure that the findings stated above remain valid. At the discretion of the Chief of Planning the item may be returned to the Planning Commission for disposition.
