FINDINGS AND CONDITIONS OF APPROVAL

FINDINGS
The Planning Commission finds as follows in regards to the
application:
The project is consistent with the goals and the
policies of the Downtown Master Plan.

The project is compatible with adjacent development and
does not impose adverse impacts on adjacent properties.
The project as conditioned will upgrade the appearance
of the site.
CONDITIONS OF APPROVAL
A. General
Ail exterior building modifications shall be completed
substantially as shown on the project drawings labeled
Danville Court, as prepared by Dinapoli-Berger
Architects dated May 13, 1988 and revised November 17,
1988 marked Exhibit "C" on file with the Planning
Department except as modified by the following
conditions of approval.

The developer shall pay any and all City and other
related fees that the property may be subject to.
These fees shall be based on the current fee schedule
in effect at the time the relevant permit is secured.

The developer shall comply with all requirements of the
San Ramon Valley Fire Protection District and the San
Ramon Valley Unified School District.
Construction and grading operations shall be limited to
weekdays (Mondays through Fridays) during the hours
from 7:30 a.m. to 5:30 p.m., unless otherwise approved
in writing by the City Engineer. If determined
necessary by the City Engineer, the area of
construction shall be fenced (in part or in its
entirety as deemed necessary by the City Engineer)
during project construction.

Ail projections (including signs, lights and awnings)
which extend into the public right-of-way shall require
an encroachment permit.
Site Planning
Ail existing exterior lighting shall be removed and
replaced by new copper fixtures. All exterior lighting
shall be subject to review and approval by the Planning
Department. All new lighting shall be installed in
such a manner that glare is directed away from
surrounding properties and rights-of-way.
Landscaping
A final landscaping plan shall be submitted for review
and approval by the Planning Department prior to the
issuance of a building permit. The existing curbing
along Prospect Avenue around the perimeter of the
parking lot shall be removed. The Final Landscape Plan
shall address replacement landscaping for these areas
abutting the parking lot.
Ail in-ground plant material shall be served by an
automatic underground irrigation system and maintained
in a healthy growing condition. The three planter
boxes along the North Hartz Avenue frontage shall be
the responsibility of the property owner and shall be
maintained in a healthy growing condition.
Ail newly installed trees shall be a minimum of 15
gallon container size and properly staked. Shrubs not
used as ground cover shall be a minimum of 5 gallons in
size°
Ail landscaped areas not covered by shrubs and trees
shall be planted with live ground cover.
Ail existing trees on the site shall be preserved to
the extent practicable: removal will be allowed only
upon written approval of the Planning Department as
indicated on final plans.
D. Architecture
Ail ducts, meters, air conditioning and/or any other
mechanical equipment whether on the structure or on the
ground shall be effectively screened from view with
landscaping or materials architecturally compatible
with the main structure(s). The highest Doint of any
roof mounted equipment shall not extend above the top
of the equipment well.

Ail trash and refuse shall be contained within
enclosures architecturally compatible with the main
structure(s). Enclosure design shall include six (6)
inch high masonry walls on three sides with steel
framed gates and wood bolted to the gates. Gates will
be self-closing and self-latching.
The street number(s) of the building(s) shall be posted
so as to be easily seen from the street at all times,
day and night.
No new project signage may be established without prior
approval of a Sign Review Permit. Signage established
under a Sign Review Permit shall be part of a
comprehensive sign program which shall be established
for the entire site.
Prior to the issuance of a building permit, samples of
final colors and materials (including the copper wash
system) selected shall be submitted to the Planning
Department for review and approval. The color scheme
for the two buildings shall be compatible and shall
coordinate with the trellis color in the Prospect
Corners mini-park.
The copper wash treatment approved for this project for
all exterior copper shall be used on an intermittent
basis to maintain the approved finish treatment to the
extent feasible.
Streets
The developer shall obtain an encroachment permit from
the Engineering Department prior to commencing any
construction activities within any public right-of-way
or easement.
Ail street signing shall be installed by the developer
as required by the City. This shall include, but is
not necessarily limited to "Stop," "No Parking," "Not a
Through Street," and street name signs. Traffic signs
and parking restriction signs shall be approved by the
Engineering Department.
Any damage to street improvements now existing or done
during construction on or adjacent to the subject
property shall be repaired to the satisfaction of the
City Engineer at full expense to the developer. This
shall include slurry seal, overlay or street
reconstruction if deemed warranted by the City
Engineer.

H. Infrastructure
Ail storm water run-off shall be collected and
conducted via an approved drainage method to the
nearest approved downstream facility.
Roof drains shall empty onto paved areas, concrete
swales, other approved dissipating devices, or into a
pipe.
Any new utilities required to serve the development
shall be installed underground.
Concentrated drainage flows shall not be permitted to
cross sidewalks or driveways.
Ail public improvement plans shall be prepared by a
licensed civil engineer.
Prior to issuance of a building permit, the owner shall
execute the deed to the Town of Danville (previously
prepared and sent to owner) for exchange of property
along the North Hartz Avenue and East Prospect Avenue
frontages of the site.
Drainage to the existing inlet located at the southwest
corner of the Jean Harris building shall be maintained
and/or provided for in a manner acceptable to the City
Engineer.
