WHEREAS, On January 25, 1988, the Plan~ing Commission conducted a duly noticed public hearing tolconsider the request of Thompson and Merrill (Applicant) and ThOmas Klaus (Owner) to permit subdivision of a 1.43 acre site into 2 parcels, and WHEREAS, the Planning Commission 'considered all public testimony and information presented duringithe public hearing regarding the proposal, and ~ WHEREAS, the Planning Commission identified concerns for development of the site related to topographic and drainage considerations, the availability of a suitable building site and consistency with the adopted Zoning Ordinance. NOW, THEREFORE, BE IT RESOLVED THAT THE PLANNING COMMISSION OF THE TOWN OF DANVILLE HEREBY DENIES MS 87-4iAND MAKES THE FOLLOWING FINDINGS IN SUPPORT OF THIS ACTION: 1) That Policy 18.02 (pg. 171) of the DanVille 2005 General Plan prohibits development on slopes greater than 30%. 2) That the 1.43 acre site contains approximately 29,000 square feet of area which exceeds 30% slope. 3) That page 49 of the Danville 2005 General Plan indicates that density shall be determined excluding land which is undevelopable due to geologic, topographic and natural factors. : 4) That the net developable area of the li43 acre site is approximately 30,700 square feet. 5) That the net developable area of the 1~43 acre site yields two sites of approximately 18,200 square feet (including the existing residence) and 12,500 square feet on Parcel A. 6) That the net developable area contained within MS 87-4 does not permit further subdivision of the i.43 acre site into 2 lots consistent with the requirements Of the adopted Zoning Ordinance and the 2005 General Plan for the Town of Danville. page 1 Of 2 - Resolution 88-1 Therefore, the proposed tentative subdivis.on is inconsistent with the intent of the general plan and zoning ordinance.
