Findings
The Town of Danville hereby finds that granting of Variance
87-20 should be denied based on the following findings:
The Zoning Ordinance, Section 84-68-806(2) requirement
which mandates that the subject trailer be used by a
family member, does not to deprive the applicant of
rights enjoyed by other property owners in the
immediate area and under the same zoning classification
in that trailers of this type do not exist on
surrounding properties and are not believed to be
appropriate uses except for members of the immediate
family in instances where the use is documented as
having existed on the property for a substantial period
of time.
In granting t]he Variance, the intent of the R-20 Zoning
District would not be met inasmuch as the purpose of
the district is to allow second units only if designed
to be architecturally compatible with the existing
house.
II. Conditions of Approval
The developmelnt shall be substantially as shown on the
project drawilngs labeled Area map for Weber Ranch and
marked Exhibit "C" on file with the Planning Department
except as modified by the following Conditions of
Approval.
The permit shall be valid for five years from the date
of approval of this application; and may be subject to
re-application after that time as needed. With
approptiate documentation, the permit may be handled
administratively and may allow for a caretaker for the
applicant.
The access drive on the applicant's property shall be
maintained to minimize dust, noise and traffic impacts
associated with the proposed use.

The mobile holme shall be painted in an "earth tone"
color during its use as a temporary second unit.
The Land Use Permit for a mobile home shall be for the
exclusive use by the applicant's brother, Herschell
Weber.
The mobile holme shall be removed from the premises
within 30 days after it is no longer in use by the
brother, Herschell Weber, or upon failure to reapply
for a Land Use Permit Extension.
Any violation of any or all of the Conditions of
Approval shall result in revocation of the Land Use
Permit and Variance.
