FINDINGS AND CONDITIONS OF APPROVAL
Short Street Market DP 87-17
FINDINGS
The proposed phase 1 of the project as conditioned is in
conformance with the Downtown Master Plan.
Proposed streetscape improvements as conditioned comply with
the approved Streetscape Beautification Guidelines.
CONDITIONS OF APPROVAL
A. General
The development shall be substantially as shown on the
project drawings labeled Short Street Market Phase I,
as prepared by Dahlin Group, Inc. dated 9/23/87 and
marked Exhibit "C" on file with the Planning Department
except as modified by the following conditions of
approval.
The developer shall pay any and all City and other
related fees 'that the property may be subject to.
These fees shall be based on the current fee schedule
in effect at 'the time the relevant permit is secured.
Notice should be taken specifically of the City's
Transportation Improvement Program (TIP) fee and the
drainage acreage fee as established by the Flood
Control District.
The developer shall comply with all requirements of the
San Ramon Valley Fire Protection District and the San
Ramon Valley Unified School District.
If archeological materials are uncovered during any
construction or pre-construction activities on the
site, all earthwork within 100 feet of these materials
shall be stopped until a professional archeologist
certified by 'the Society of California Archeology
and/or the Society of Professional Archeology has had
an opportunity to evaluate the significance of the find
and to suggest appropriate mitigation measures, if they
are deemed necessary.
Construction and grading operations shall be limited to
weekdays (Mondays through Fridays) during the hours
from 7:30 a.m. %o 5:30 p.m. ~ unless okherwlse approved
in writing by the City Engineer.

This project shall conform with all requirements of the
Downtown Master Plan, Streetscape Beautification
Guidelines and Plan (when it is complete).
An historical evaluation of the house located at 219
Hartz Avenue shall be done by a qualified professional
acceptable to staff prior to approval of a development
plan which ei'ther alters, attaches to or removes the
existing structure. This evaluation will be required
if consideration of any development plans on the site
occur prior to a Town Council decision regarding the
historical significance of the structure.
B. Site Planning
Ail lighting shall be installed in such a manner that
glare is directed away from surrounding properties and
rights-of-way. All parking lot lighting shall be
reviewed and approved by the Planning Department.
C. Landscapinq
1. A final landscaping plan which includes additional shade
trees in the parking lot area shall be submitted for
review and approval by the Planning Department prior to
construction of any of the proposed improvements. The
intent of this ]provision is to provide for additional
shade trees in 'the parking lot area while not eliminating
the 18 on-site ]parking spaces. If the redesign must
eliminate parking spaces, then the site plan shall be
approved by the Planning Commission.
2. Ail plant material shall be served by an automatic
underground irrigation system and maintained in a healthy
growing condition.
3. Ail trees shall be a minimum of 15 gallon container size
and properly staked. Specimen size trees shall be
integrated into the landscaping plan. Shrubs not used as
ground cover shall be a minimum of 5 gallons is size.
4. Ail landscaped areas not covered by shrubs and trees
shall be planted with live ground cover.
5. Ail existing trees on the site shall be preserved to the
extent practicable: removal will be allowed only upon
written approval of the Planning Department as indicated
on final plans.

2. Specifications ifor the decorative pavers on the public
right-of-way shall be consistent with the Downtown
Streetscape Plan when it is completed.
3. The type of parking lot shade tree shall be reviewed and
approved by Town landscape staff.
Parking
1. Ail parking spaces shall be striped and fronted by
concrete curbs with sufficient areas provided beyond the
ends of all parking spaces to accommodate the overhang of
automobiles.
2. The compact car ratio shall equal 30% of the total
parking spaces ]provided on site. Where authorized,
compact car spaces shall be clearly designated with
appropriate pawsment marking or signage. Compact spaces
shall be no less than 8 feet by 16 feet in size including
allowable overhang.
Gradinq
Any grading oln adjacent properties will require written
approval of tlhose property owners affected.
Plans accompalnying the application for building permits
for phase 2 of the project shall show existing
contours, the extent of the proposed grading and
drainage improvements.
Streets
The developer shall obtain an encroachment permit from
the Engineerilng Department prior to commencing any
construction activities within any public right-of-way
or easement.
Ail street signing shall be installed by the developer
as required by the City. This shall include, but is
not necessarily limited to "Stop," "No Parking," "Not a
Through Stree't,'' and street name signs. Traffic signs
and parking restriction signs shall be approved by the
Police Departlment.
The developer shall keep adjoining public streets free
and clean of project dirt, mud, materials and debris
during the colnstruction period, as is found necessary
by the City Engineer.

Handicapped ramps shall be provided along the driveway
approaches and located as required by the City
Engineer.
Any damage to street improvements now existing or done
during construction on or adjacent to the subject
property shall be repaired to the satisfaction of the
city Engineer at full expense to the developer. This
shall include slurry seal, overlay or street
reconstruction if deemed warranted by the City
Engineer.
Construct new curb and gutter, repair the sidewalk and
install street lighting on the Hartz Avenue frontage,
as required by the City Engineer and in accordance with
the Downtown Streetscape Plan when it is complete.
Construct new frontage improvements (drainage inlet,
curb, gutter, 8 - 10 foot sidewalk, pavement widening,
street lighting, etc.) on Railroad Avenue as required
by the City Engineer and in accordance with the
Downtown Streetscape Plan when it is completed.
A standard driveway approach with handicap ramps shall
be constructed at both access drives.
H. Infrastructure
Ail storm water run-off shall be collected and
conducted via an approved drainage method to the
nearest approved downstream facility.
Off-site drainage flows shall be intercepted at the
project boundary via an approved storm drain facility,
or as approved by the city.
