Permit LUP 84-10 (CHARLES AND
EILEEN VIOLET (OWNERS), TELEVENTS,
INC. (APPLICANT)
RESOLUTION NO. 84-1
The Applicant, a commercial cable communications
company as part of its operation to provide cable television
service to Danville and other portions of the San Ramon Valley,
applied for a land use permit for a "commercial television
receiving facilities" under sections 84-14.404 and 84-4o404(11)
of the County Ordinance Code as adopted by the City by
reference;
The facilities are allowable in an R-20 district on the
issuance of a land use permit;
The Planning Commission conducted a public hearing on
June 25, 1984, to consider this application;
This project is categorically exempt from the
requirements of California Environmental Quality Act (Public
Resources Code Section 21000, et seq.);
This use will be consistent with the policies and goals
of the City's general plan~
The City's staff recommends approval subject to conditions;
and
A land use permit approval is governed by the procedures
contained in section 26-2.2008 of the County Ordinance Code as

adopted by reference (variance, conditional use and special
permits - conditional use permit standards).
NOW, THEREFORE, the Planning Commission of the City of
Danville, after hearing public testimony, finds and determines
that: ~'~
1. The findings under section 26-2.2008 are as follows:
(a) The proposed use of the land for a commercial
television receiving facility, consisting of a small
unmanned utility building and a self-supporting single
pole tower with a microwave receiving dish, will not
be detrimental to the health, safety and general welfare
of the City in that the location of the site is isolated,
can be barely seen from the surrounding area, and is well
hidden from public view by the adjacent hillside and trees.
(b) The use of the property for these purposes does
not adversely affect the orderly development of property
within the City in that this use only occupies approximately
390 square feet of land and as such will not affect any other
development of adjacent property.
(c) The use will not adversely affect the preservation
of property values and the protection of the tax base within
the City because of its limited size and the limited nature of
its use.
(d) The use does not adversely affect the policies and
goals as set by the general pian as this use as proposed is

compatible with the single family, low density residential
goals and policies of the City's general plan. This
limited use will not hinder those policies and goals.
(e) The use will not create a nuisance or an enforce-
ment problem within the neighborhood or community ~gcause
it will blend in with tlhe surrounding area and because of
its small size and operation, no physical activity will
take place.
(f) The use will not encourage marginal development
within the neighborhood because the receiving site is
special to this location is not developmental oriented or
growth oriented.
(g) Special conditions and unique characteristics of
the Violet property and its location and surroundings are
established in that the receiving structure will be hidden
from public view by the adjacent hillside and trees and
will be so camouflaged as to blend in with the surrounding
vegetation. The siting on the Violet parcel is strategically
located for microwave receive site in relationship to
applicant's Briones Peak transmitting site, and is necessary
to the overall operation of Televents in order to provide
cable television service to the Danville area and other
portions of San Ramon Valley.
2. The land use permit LUP 84-10 for a microwave receiving
station located at 813 LaGonda Way (parcel 200-080-011) is granted
subject to the conditions contained in Exhibit A attached and

incorporated by this reference.
