AMENDING SECTION 3-9.4 OF THE DANVILLE MUNICIPAL CODE
RELATING TO THE TRI-VALLEY TRANSPORTATION
DEVELOPMENT FEES FOR TRAFFIC MITIGATION
The Danville Town Council does ordain as follows:
SECTION 1. FINDINGS.
The Town of Danville, along with the Cities of San Ramon, Dublin, Pleasanton and
Livermore, and the Counties of Contra Costa and Alameda, entered into the Joint
Exercise of Powers Agreement Pertaining to Tri-Valley Transportation Development
Fees for Traffic Mitigation ("JEPA'). The purpose of the JEPA was to cooperatively
collect traffic mitigation fees on a regional basis.

In order to implement the JEPA, the Town of Danville adop.ted Ordinance No. 98-
08. That ordinance, codified in the Danville Municipal Code as Chapter 3-9,
established the Tri-Valley Transportation Fees for six different land use categories.
At its duly noticed April 15, 2003 pu~blic hearing, the Town of Danville adopted
Resolution No. 36-2003 supporting the proposed interim fee adjustment.
As provided for in the JEPA, the TVTC at its duly noticed April 23, 2003 public
meeting, has unanimously adopted the interim fee adjustment and forwarded the
interim fee adjustment to all Parties to the JEPA for local fee ordinance amendment
and adoption.
SECTION 2. AMENDING SECTION 3-9.4 OF THE DANVILLE MUNICIPAL CODE.
Section 3-9.4 of the Danville Municipal Code is hereby amended to reflect the following
adjusted fees:

SECTION 3. CODIFICATION.
Section 2 of this ordinance shall be codified in the Danville Municipal Code.
SECTION 4. PUBLICATION AND EFFECTIVE DATE.
The City Clerk shall have this ordinance published in a newspaper of general circulation
within fifteen (15) days after adoption. This ordinance shall become effective 60 days after
adoption.
The foregoing ordinance was introduced on May 20, 2003 and approved and adopted by
the Danville Town Council at a regular meeting held on June 3, 2003, by the following vote:
