AMENDING SECTION 17-21.2 OF THE DANVILLE MUNICIPAL CODE
EXTENDING THE TERM OF THE AT&T CABLE TELEVISION FRANCHISE
The Danville Town Council does ordain as follows:
SECTION 1. FINDINGS.
1. The Town Council of the Town of Danville adopted Ordinance No. 97-86, granting a
non-exclusive cable television franchise to Televents. Through a series of transfers
approved since then by the Danville Town Council, the current franchisee is AT&T. The
Ordinance is codified as Chapter 17-21 of the Danville Mtmicipal Code. The franchise
was for a term of 15 years and expired on August 18, 2001.
2. Prior to expiration of the franchise, AT&T submitted a request to initiate formal franchise
renewal proceedings under Section 626(a) of the Cable Communications Policy Act of
1984. The Town and AT&T have been and remain engaged in negotiations for renewal
of the franchise.
3. The Town has now received a request from AT&T to extend the term of the franchise
while negotiations are continuing. The Town Council finds that extending the term of the
franchise through June 30, 2002 is in the best interests of the Town.
4. The Town's extension of the AT&T franchise is subject to all existing terms and
conditions of the franchise, including the requirement that transfers of ownership are
subject to Town approval.
SECTION2. AMENDING SECTION 17-21.2 OF THE DANVILLE MUNICIPAL
CODE.
Section 17.21.2 of the Danville Municipal Code is hereby amended to read as follows:
17-21.2 Duration of Franchise. The franchise granted by this section shall expire on
June 30, 2002.
SECTION 3. CODIFICATION.
Section 2 of this ordinance shall be codified in the Danville Municipal Code.
SECTION 4. PUBLICATION AND EFFECTIVE DATE. The City Clerk shall have
this ordinance published in a newspaper of general circulation within fifteen (15) days after
adoption. This ordinance shall become effective 30 days after adoption.
The foregoing Ordinance was introduced on January 15, 2002 and approved and adopted by
the Danville Town Council at a regular meeting held on February 5, 2002, by the following
vote:
