HomeMy WebLinkAbout2001-04ORDINANCE NO. 2001-04 ADDING SECTION 31-31.3 TO THE DANVILLE MUNICIPAL CODE RELATING TO THE USE OF RECYCLED WATER IN SUBDIVISIONS The Danville Town Council does ordain as follows: SECTION 1. FINDINGS AND INTENT. A. In adopting SB 2095, the State of California has declared that it is the policy of the state to promote the efficient use of water through the development of water recycling facilities. Furthermore, the state found that the use of potable rather than recycled water for landscaped areas in new subdivisions is an unreasonable use of this scarce resource. B. The East Bay Municipal Utility District (EBMUD) has informed the Town of Danville that it will be able to provide recycled water to areas of the Town within the next ten years. EBMUD has provided the Town with the required maps showing which areas of Town will be provided with recycled, water service. C. The intent of this ordinance is to establish procedures to ensure that new subdivisions within the Town of Danville are required to install separate plumbing systems for the use of recycled water in common area landscaping when and where such recycled water is made available. SECTION 2. ADDING SECTION 31-31.3 TO THE DANVILLE MUNICIPAL CODE. Section 31-31.3 is hereby added to the Danville Municipal Code to read as follows: 31-31.3 Recycled Water. a. All subdivisions of five (5) lots or more located within designated recycled water use areas shall be required to install a recycled water distribution system to provide recycled water to common landscaped areas of the subdivision. b. For purposes of this section, "designated recycled .water use areas" shall mean those geographic areas of the Town identified by the East Bay Municipal Utility District or other recycled water provider as having a dependable supply of recycled water available or where the feasibility of distributing a supply of recycled water has been determined. The Town shall maintain on file the most recent information provided by East Bay Municipal Utility District or other recycled water provider. c. For purposes of this section, "recycled water system" shall mean a system of pipes, pumps and other equipment necessary to deliver recycled water separate from any potable water system. The system shall comply 'with all applicable building and plumbing codes. d. For purposes of this section, "common landscaped areas" shall include, but is not limited to, private greenbelts, landscaped medians, recreational areas or other commonly owned areas. SECTION 3. CODIFICATION. Section 2 of this ordinance shall be codified in the Danville Municipal Code. SECTION 4. SEVERABILITY. If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of the ordinance. The Danville Town Council hereby declares that they would have adopted the ordinance, and each section, subsection, sentence, clause, or phrase thereof, irrespective of the fact that one or more sections, subsections, sentences, clauses or phrases was declared invalid. SECTION 5. PUBLICATION AND EFFECTIVE DATE. The City Clerk shall have this ordinance published once within 15 (fifteen) days after adoption in a newspaper of general circulation. This ordinance shall become effective 30 days after adoption.
