AMENDING SECTION 3-9.4 OF THE DANVILLE MUNICIPAL CODE
RELATING TO TRI-VALLEY TRANSPORTATION
DEVELOPMENT FEES FOR TRAFFIC MITIGATION
The Danville Town Council does ordain as follows:
SECTION 1. FINDINGS.
1. The Town of Danville, along with the Cities of San Ramon, Dublin, Pleasanton and
Livermore, and the Counties of Contra Costa and Alameda, entered into the Joint
Exercise of Powers Agreement Pertaining to Tri-Valley Transportation Development
Fees for Traffic Mitigation (the "JEPA"). The purpose of the JEPA was to cooperatively
collect traffic mitigation fees on a regional basis.
2. In order to implement the JEPA, the Town adopted Ordinance 98-08. That ordinance,
codified in the Danville Municipal Code as Chapter 3-9, established the Tri-Valley
Transportation Fees for six different land use categories.
3. As provided for in the JEPA, the participating entities have reviewed the adopted fees
and have collectively determined that the fee for the "Other" land use category should be
adjusted so as to accurately reflect a reasonable relationship between the amount of the
fee and the impact of such development on regional transportation facilities in the Tri-
Valley area.
SECTION2. AMENDING SECTION 3-9.4 OF THE DANVILLE MUNICIPAL
CODE.
Section 3-9.4 of the Danville Municipal Code is hereby amended by changing the
recommended fee for the "Other" land use category to $610 per peak hour trip.
SECTION 3. CODIFICATION.
Section 2 of this ordinance shall be codi~ed in the Danville Municipal Code.
SECTION 4. PUBLICATION AND EFFECTIVE DATE. The City Clerk shall have
this ordinance published in a newspaper of general circulation within fifteen (15) days after
adoption. This ordinance shall become effective 60 days after adoption.
The foregoing Ordinance was introduced on October 5, 1999 and approved and adopted by
the Danville Town Council at a regular meeting held on October 19, 1999, by the following
vote:
