HomeMy WebLinkAbout99-07 ORDINANCE NO. 99-07 AMENDING SECTION 17-20.3 OF THE DANVILLE MUNICIPAL CODE EXTENDING THE TERM OF THE PONDEROSA CABLE SYSTEMS FRANCHISE The Danville Town Council does ordain as follows: SECTION 1. FINDINGS. 1. The Town Council of the Town of Danville adopted Ordinance No. 36-84 on July 16, 1984, granting a non-exclusive cable television franchise to Ponderosa Cable Systems Limited. The ordinance is codified as Chapter 17-20 of the Danville Municipal Code. The franchise was for a term of 15 years and would expire on August 16, 1999. 2. The Town has received a request from Ponderosa to extend the term of the franchise until August 31,2001. 3. Extending the term of the Ponderosa franchise by two years will allow the Town to consider the cable television franchise application submitted by Seren Technologies and to review and consider the request to renew the cable television franchise previously granted to TCI. Extension will also match the term of the Ponderosa franchise for areas of unincorporated Contra Costa County immediately adjoining the portion of Danville served by Ponderosa. 4. At the expiration of the extended term, Ponderosa will be subject to a full renewal process as prescribed by ordinance. 5. The Town's extension of the term of the Ponderosa franchise is subject to all existing terms and conditions of the franchise. SECTION2. AMENDING SECTION 17-20.3 OF THE DANVILLE MUNICIPAL CODE. Section 17.20.3 of the Danville Municipal Code is hereby amended to read as follows: 17-20.3 Duration of Franchise. The franchise granted by this section shall expire on August 31,2001. SECTION 3. CODIFICATION. Section 2 of this ordinance shall be codified in the Danville Municipal Code. SECTION 4. PUBLICATION AND EFFECTIVE DATE. The City Clerk shall have this ordinance published in a newspaper of general circulation within fifteen (15) days after adoption. This ordinance shall become effective 30 days after adoption.
