HomeMy WebLinkAbout99-02ORDINANCE NO. 99-02 ADDING CHAPTER 2-14 TO THE DANVILLE MUNICIPAL CODE RELATING TO THE COMPOSITION AND ROLE OF THE DESIGN REVIEW BOARD The Danville Town Council does ordain as follows: SECTION 1. ADDING CHAPTER 2-14 TO THE DANVILLE MUNICIPAL CODE. Chapter 2-14 is hereby adopted and added to the Danville Municipal Code to read as follows: 2-14 DESIGN REVIEW BOARD 2-14.1 Creation of Design Review Board. A Design Review Board ("DRB") of the Town of Danville is hereby established. The DRB shall be composed of no less than three (3) and no more than five (5) regular members. Of the total membership, a minimum of two (2) and maximum of three (3) DRB members shall be members of the Town of Danville's Planning Commission. In selecting the remaining at-large members of the DRB, it is the intent of the Town Council to, whenever possible, select architects, landscape architects or others with special training or experience related to architecture or design. 2-14.2 Role of the DRB. The Town of Danville's General Plan emphasizes the importance of community design for new residential and commercial development in order to preserve and enhance the existing character of the Town. The role of the DRB is to assist the Town Council and Planning Commission in reviewing and evaluating proposed design, architecture, landscaping and signs to ensure consistency with the Town's General Plan, ordinances and adopted design standards and criteria. In order to achieve this goal, the DRB shall: a. Review and make recommendations regarding proposed design, architecture, signs and landscaping plans submitted along with planning or land use applications to the Town. The DRB's recommendations shall be forwarded to the Town Council, Planning Commission or Planning staff as appropriate. b. Review and approve proposed signs as provided for in the Town's sign ordinance. c. Review and approve design, architecture or landscaping plans as authorized by the Town Council through ordinance or resolution of the Town Council. d. Review and make recommendations regarding any Town sponsored project as requested by the Town Council or Town staff. 2-14.3 Term of Office. The term of office of each regular member is four (4) years unless otherwise determined by the Town Council. Members of the DRB may continue to serve until their successor is appointed and assumes office. 2-14.4 Removal or Vacancy. A member of the DRB may be removed at any time by a majority vote of the Town Council. Any vacancy on the DRB shall be filled by appointment of the Town Council. Any person selected to fill a vacancy shall serve for the remainder of the unexpired term. 2-14.5 Absence from Meeting. If a member of the DRB is absent without cause from three (3) successive regular meetings of the Board, their office shall automatically become vacant. The DRB shall immediately notify the Town Council of the vacancy. A member is not absent without cause if their absence is due to illness or is otherwise unavoidable and the member provides notice of their absence prior to the meeting. 2-14.6 No Compensation. Members of the DRB do not receive compensation for attendance at DRB meetings, but are entitled to reimbursement for expenses incurred in the course of their duties upon approval by the Town Council. 2-14.7 Adoption of Rules. The DRB shall adopt rules and procedures for the transaction of its business. The DRB shall keep a public record of its actions. 2-14.8 Time and Place of Regular Meeting. The DRB shall fix the time and place of its regular meetings by resolution, by-law or other official action of the DRB. Special meetings may be called as necessary. All meetings of the DRB are open to the public and the DRB shall give notice of its meetings as required by law. 2-14.9 Residency Requirement. All members of the DRB shall be residents of the Town of Danville. SECTION 2. CODIFICATION. Section 1 of this ordinance shall be codified in the Danville Municipal Code. SECTION 3. PUBLICATION AND EFFECTIVE DATE. The City Clerk shall have a summary of this ordinance published twice in a newspaper of general circulation, once within five (5) days before its adoption and once within 15 (fifteen) days after adoption. This ordinance shall become effective 30 days after adoption.
