AN ORDINANCE OF THE TOWN OF DANVILLE REPEALING
EXISTING CHAPTER VII SECTION 4 OF THE DANVILLE MUNICIPAL CODE
AND ADOPTING BY REFERENCE THE CENTRAL CONTRA COSTA COUNTY
SOLID WASTE AUTHORITY ORDINANCE
REGULATING SOLID WASTE, GREEN WASTE AND RECYCLABLE MATERIAL
The Danville Town Council does ordain as follows:
SECTION 1. REPEALING CHAPTER VII. SECTION 4 OF THE DANVILLE MUNICIPAL
CODE.
The existing Chapter VII, Section 4 of the Danville Municipal Code, relating to refuse collection,
is hereby repealed in its entirety.
SECTION 2. ADOPTING A NEW CHAPTER VII. SECTION 4 OF THE DANVILLE
MUNICIPAL CODE ADOPTING BY REFERENCE THE CENTRAL
CONTRA COSTA COUNTY SOLID WASTE AUTHORITY ORDINANCE
REGULATING SOLID WASTE, GREEN WASTE AND RECYCLABLE
MATERIAL COLLECTION, PROCESSING, DISPOSAL AND LITTER
A new Chapter VII, Section 4 is hereby added to the Danville Municipal Code adopting by reference
the Central Contra Costa Solid Waste Authority ordinance regulating solid waste, green waste and
recyclable material collection, processing, disposal and litter (Central Contra Costa Solid Waste
Authority Ordinance No. 97-01) in its entirety. The new Chapter VII, Section 4 shall read as
follows:
CHAPTER VII
7-4 REFUSE COLLECTION
7-4.1 Central Contra Costa Solid Waste Authority Ordinance Adopted
The Central Contra Costa Solid Waste Authority's ordinance regulating solid waste, green waste and
recyclable material collection, processing, disposal and litter (Ordinance No. 97-01 of the Central
Contra Costa Solid Waste Authority) is adopted by reference in its entirety. The Town of Danville
shall adopt all future amendments to the ordinance so long as the Town remains a member of the
Solid Waste Authority.
7-4.2 Penalties
Violation of this Section shall be subject to the penalties established by the Central Contra Costa
Solid Waste Authority but shall not exceed a fine of thousand dollars ($1,000) and/or 30 days in
prison per violation occurrence.
SECTION 3. SEVERABILITY. The Town Council hereby declares that every section,
paragraph, clause and phrase of this Ordinance is severable. If any section, paragraph, sentence,
clause or phrase of this Ordinance is for any reason held to be invalid or unconstitutional, such
invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining
sections, paragraphs, sentences, clauses or phrases.
SECTION 4. CODIFICATION.
Section 2 of this Ordinance shall be codified in the Danville Municipal Code.
SECTION 5. PUBLICATION. The City Clerk shall have a summary of this Ordinance
published twice in a newspaper of general circulation, once five days before its adoption and again
within 15 (fifteen) days after adoption.
The foregoing Ordinance was introduced on December 16, 1997 and approved and adopted by the
Danville Town Council at a regular meeting held on January 20, 1998, by the following vote:
