REPEALING EXISTING CHAPTER VI OF THE DANVILLE MUNICIPAL CODE
AND ADOPTING BY REFERENCE CONTRA COSTA COUNTY'S
ANIMAL CONTROL ORDINANCE INCLUDING PENALTIES
FOR ABANDONMENT OF ANIMALS
The Danville Town Council does ordain as follows:
SECTION 1. REPEALING CHAPTER VI OF THE DANVILLE MUNICIPAL CODE.
The existing Chapter VI of the Danville Municipal Code, relating to animal control, is hereby
repealed in its entirety.
SECTION 2. ADOPTING A NEW CHAPTER VI OF THE DANVILLE MUNICIPAL
CODE TO ADOPT BY REFERENCE THE CONTRA COSTA COUNTY
ANIMAL CONTROL ORDINANCE
Pursuant to the authority granted by Government Code Section 50022.9, a new Chapter VI is
hereby added to the Danville Municipal Code to adopt by reference the Contra Costa County
animal control ordinance (Division 416 of the Contra Costa County Code) in its emirety. The
new Chapter VI shall read as follows:
CHAPTER VI
ANIMAL CONTROL
6-1 County Ordinance Adopted
The Contra Costa County animal control ordinance, Division 416 of the Contra Costa County
Code, is adopted by reference in its entirety, including all amendments effective as of November
5, 1997. The provisions of this ordinance shall be enforced by the Contra Costa County Animal
Services Department pursuant to the agreement between the Town of Danville and the County.
6-2 Penalties
Violation of this Chapter shall be subject to the penalties of the Coumy ordinance, set forth as
follows:
(a)
Notwithstanding Section 14-8.004, and pursuant to Food and Agriculture Code Section
31401, violations of Division 416 of this code, excepting Chapter 416-10 and Article
416-12.2, are punishable by a fine of not more than fifty dollars for the first offense, and
not more than one hundred dollars for the second or subsequent offense.
(b)
Notwithstanding subsection (a) above, violation of section 416-4.404 Abandonment,
excluding abandonments under section 416-8.014, is a misdemeanor and punishable as
such.
SECTION 3. SEVERABILITY.
The Town Council hereby declares that every section, paragraph, clause and phrase of this
Ordinance is severable. If any section, paragraph, sentence, clause or phrase of this Ordinance
is for any reason held to be invalid or unconstitutional, such invalidity or unconstitutionality
shall not affect the validity or constitutionality of the remaining sections, paragraphs, sentences,
clauses or phrases.
SECTION 4. CODIFICATION.
Section 2 of this Ordinance shall be codified in the Danville Municipal Code.
SECTION 5. PUBLICATION.
The City Clerk shall either (a) have this Ordinance published once within 15 (fifteen) days after
adoption in a newspaper of general circulation, or (b) have a summary of this Ordinance
published twice in a newspaper of general circulation once'five days before its adoption and
again within 15 (fifteen) days after adoption.

The foregoing Ordinance was introduced on November 5, 1997 and approved and adopted by
the Danville Town Council at a Regular Meeting held on December 16, 1997, by the following
vote:
