HomeMy WebLinkAbout97-04 ORDINANCE NO. 97-04 AN ORDINANCE OF THE TOWN OF DANVILLE APPROVING PRELIMINARY DEVELOPMENT PLAN - REZONING REQUEST PUD 96-04 -- PODVA ROAD APARTMENTS The Danville Town Council DOES ORDAIN AS FOLLOWS: SECTION 1. Rezoning. The 2.33 +/- acre parcel located at the southwest comer of San Ramon Valley Blvd. and Podva Road, further identified as Assessor's Parcel Numbers 207-011-004 &-010 is rezoned from M-12: Multiple Family Residential District to P- 1; Planned Unit Development District allowing the development of a maximum of 38 apartment units. Rezoning is based on the conditions of approval contained within Resolution No. 77-97. Resolution No. 77-97, and all attachments thereto, is hereby incorporated by reference. SECTION 2. Zoning Map. The Zoning Map of the Town of Danville is amended accordingly. SECTION 3. Publication. The City Clerk shall either a) have this Ordinance published once within 15 days after adoption in a newspaper of general circulation or b) have a summary of this ordinance published twice in a newspaper of general circulation, once five days before its adoption and again within 15 days after adoption. SECTION 4. Effective Date. This Ordinance becomes effective thirty (30) days after its adoption. The foregoing ordinance was first read and introduced on July 15, 1997 and approved and adopted by the Danville Town Council at a regular meeting held on August 5, 1997 by the foil[owing vote: AYES: Doyle, Waldo, NOES: Shimansky ABSTAIN: None ABSENT: None Arnerich, Greenberg YOR APP~OVED AS TO FORM: CITY ATTORNEY CITY CLERK CLERK'S CERTIFICATE I, Marie Sunseri, City Clerk of the Town of Danville, hereby certify that the foregoing is a true and accurate copy of Ordinance No. 97-04 of said Town and that said ordinance was published according to law.
