HomeMy WebLinkAbout96-12ORDINANCE NO. 96-12 APPROVING REVISED PRELIMINARY DEVELOPMENT PLAN - REZONING REQUEST PUD 95-04 ALAMO SPRINGS/CORRIE DEVELOPMENT CORPORATION The Danville Town Council DOES ORDAIN AS FOLLOWS: SECTION 1. Findings. 1. The proposed project is consistent with the Danville 2005 General Plan. . The uses authorized or proposed in the land use district are compatible within the district and to uses authorized in adjacent districts. 3. Community need has been demonstrated for the use proposed. o The project will be subject to the mitigation measures established for the site in the Final Environmental Impact Report (FEIR) for the previously approved project for this site. . Based on completion of the Initial Study of Environmental Significance and comments received, there is no substantial evidence before the Town that the project will have a significant adverse effect on the environment (assumes application of mitigation measures from the aforementioned FEIR). . Pursuant to the Memorandum of Understanding executed between the Town of Danville and Contra Costa County pertaining to the subject properties, the Findings and Conditions of Approval for the below referenced Town entitlements match exactly the Findings and Conditions of Approval for the corresponding County entitlements (i.e., County-files 2882-RZ; DP 3003-90; DP 3006-93; and SD 7453). SECTION 2. Rezoning. The 148 +/- acres located at the northern terminus of La Gonda Way, northeast of Highway 1-680 in the Danville-Alamo area, further identified as Assessor's Parcel Numbers 197-082-014, -016, - 017, -018, -020 AND 197-050-024, is rezoned from P-l; Planned Unit Development District to a new P-l; Planned Unit Development District. Rezoning is based upon the approved Final Development Plan - Major Subdivision request DP 95-26 and SD 7452 and the Findings and Conditions of Approval contained within Town Council Resolution No. 96-172. That resolution, and all exhibits thereto, is incorporated by reference. SECTION 3. Zonine Map. Publication. The City Clerk shall either a) have this Ordinance published once within 15 days after the adoption in a newspaper of general circulation or b) have a summary of this ordinance published twice in a newspaper of general circulation, once five days before its adoption and again within 15 days after adoption. SECTION 5. Effective Date. This Ordinance becomes effective 30 days after its adoption.
