ADDING SECTION 4-14.2 TO THE DANVILLE
MUNICIPAL CODE RELATING TO PUBLIC
CONSUMPTION OF ALCOHOLIC BEVERAGES
The Danville Town Council does ordain as follows:
SECTION 1. ADDING SECTION 4-14.2 OF THE DANVILLE MUNICIPAL CODE.
Section 4-14.2 is hereby added to the Danville Municipal Code to read as follows:
4-14.2 Public Consumption of Alcoholic Beverages.
a.
No person shall consume any alcoholic beverage in any quantity on any public
street, avenue, boulevard, sidewalk, alley or public parking lot, or on private
parking lots, shopping centers or other commercial properties open to the general
public, unless expressly permitted pursuant to subsection (b) below.
b.
This section shall not apply to those areas and at such times as the Town Council
has granted temporary use and occupancy of public streets and has permitted the
possession and consumption of alcoholic beverages or has approved the possession
and consumption of alcoholic beverages on private parking lots, shopping centers
or other commercial properties open to the general public. In addition to Town
Council approval, all other required permits and licenses must be obtained.

For purposes of this section, "alcoholic beverage" means and includes alcohol,
spirits, liquor, wine, beer and every liquid containing alcohol, spirits, wine or beer.
d. Any person violating this chapter shall be guilty of an infraction.
SECTION 2. SEVERABILITY. The Town Council hereby declares that every section,
paragraph, clause and phrase are severable. If any section, paragraph, sentence, clause or phrase
of this Ordinance is for any reason held to be invalid or unconstitutional, such invalidity or
unconstitutionality shall not affect the validity or constitutionality of the remaining sections,
paragraphs, sentences, clauses or phrases.
SECTION 3. PUBLICATION. The City Clerk shall either (a) have this Ordinance
published once within 15 (fifteen) days after adoption in a newspaper of general circulation or,
(b) have a summary of this Ordinance published twice in a newspaper of general circulation once
five days before its adoption and again within 15 (fifteen) days after adoption.
SECTION 4. CODIFICATION. Section 1 of this Ordinance shall be codified in the
Danville Municipal Code. Sections 2, 3 and 4 shall not be codified.
The foregoing Ordinance was introduced on October 1, 1996 and approved and adopted by the
Danville Town Council at a Regular Meeting held on October 15, 1996, by the following vote:
