HomeMy WebLinkAbout95-07ORDINANCE NO. 95-07 AN ORDINANCE OF THE TOWN OF DANVILLE ADDING SECTION 2-3 OF THE DANVILLE MUNICIPAL CODE, RELATING TO THE DESIGNATION OF THE FINANCE DIRECTOR AS THE TOWN TREASURER THE TOWN COUNCIL OF THE TOWN OF DANVILLE DOES ORDAIN AS FOLLOWS: SECTION 1. PURPOSE AND INTENT. The purpose and intent of this Ordinance is to designate the Finance Director as the Town Treasurer. In this regard, the Danville Town Council hereby finds, based on the staff report submitted herewith, and oral and documentary evidence submitted to the Town Council at a public hearing on August 1, 1995, that the Finance Director shall act as the Town Treasurer, with ultimate responsibility to protect, preserve and maintain cash and investments of the Town of Danville. SECTION 2. SECTION 2-3 ADDED. Section 2-3 of Article II of Chapter II is hereby added to the Danville Municipal Code, and such Section shall read as follows: Section 2-3: TOWN TREASURER Section 2-3.1: Designation of the Town Treasurer. The Finance Director of the Town shall also act as the Town Treasurer. Section 2-3.2: Powers and Duties. To direct, manage and review the Town's investment program for the purpose of protecting, preserving and maintaining cash and investments in accordance with California Government Code Sections 53601 et seq. and the Town's Investment Policy. SECTION 3. SEVERABILITY. The Town Council hereby declares that every section, paragraph, clause and phrase are severable. If any section, paragraph, sentence, clause or phrase of this Ordinance is for any reason held to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining sections, paragraphs, sentences, clauses or phrases. The Acting City Clerk shall either (a) have this Ordinance published once within 15 (fifteen) days after adoption in a newspaper of general circulation or, (b) have a summary of this Ordinance published twice in a newspaper of general circulation once five days before its adoption and again within 15 (fifteen) days after adoption. SECTION 5. CODIFICATION: Section Two shall be codified in the Danville Municipal Code. Sections One, Three, Four-and Five shall NOT be codified in the Danville Municipal Code. Article III of Chapter II shall be modified to reserve only Sections 2-4 to 2-6.
