HomeMy WebLinkAbout95-03ORDINANCE NO. 95-3 AN ORDINANCE OF THE TOWN OF DANVILLE ADDING SECTIONS 2-7.12, 2-10.13, 2-11.13 AND 2-13.13 AND AMENDING SECTIONS 2-7.2, 2-10.3, AND 2-11.3 OF THE DANVILLE MUNICIPAL CODE RELATING TO RESIDENCY REQUIREMENTS AND TERMS OF OFFICE OF TOWN COMMISSION MEMBERS THE TOWN COUNCIL OF THE TOWN OF DANVILLE DOES ORDAIN AS FOLLOWS: SECTION 1. PURPOSE AND INTENT: The purpose and intent of this ordinance is to amend Article IV, Chapter 2 of the Danville Municipal Code regarding residency requirements and terms of office for the Planning Commission, Parks and Leisure Services Commission, Heritage Resource Commission and Arts Commission. SECTION 2. Section 2-7.2 of Chapter II of the Danville Municipal Code is hereby amended to read in its entirety as follows: 2-7.2 Term of Office. The term of office of each regular member is four (4) years unless otherwise determined by the Council. Each regular member shall serve until their successor is appointed and qualified. The term of office of any alternate members shall be for terms so designated by the Council at the time of their appointment. SECTION 3. Section 2-7.12 is hereby added to Chapter II of the Danville Municipal Code to read in its entirety as follows: 2-7.12 Residency Requirement. All members of the Commission and any alternates shall be residents of the Town of Danville. SECTION 4. Section 2-10.3 of Chapter II of the Danville Municipal Code is hereby amended to read in its entirety as follows: Section 2-10.3 Term of Office. The term of office of each member of the Commission is four (4) years unless otherwise determined by the Council. Each member shall serve until their successor is appointed and qualified. SECTION 5. Section 2-10.13 is hereby added to Chapter n of the Danville Municipal Code to read in its entirety as follows: 2-10.13. Residency Requirement. All members of the Commission shall be residents of the Town of Danville. SECTION 6. Section 2-11.3 of Chapter II of the Danville Municipal Code is hereby amended to read in its entirety as follows: 2-11.3 Term of Office. The term of office of each member of the Commission is three (3) years unless otherwise determined by the Council. Each member shall serve until their successor is appointed and qualified. SECTION 7. Section 2-11.13 is hereby added to Chapter II of the Danville Municipal Code to read in its entirety as follows: 2-11.13. Residency Requirement. All members of the Commission shall be residents of the Town of Danville. SECTION 8. Section 2-13.13 is hereby added to Chapter II of the Danville Municipal Code to read in its entirety as follows: 2-13.13. Residency Requirement. All members of the Commission shall be residents of the Town of Danville or residents of the contiguous unincorporated area surrounding the Town of Danville. SECTION 9. SEVERABILITY. The Town Council hereby declares that every section, paragraph, clause and phrase are severable. If any section, paragraph, sentence, clause or phrase of this Ordinance is for any reason held to be invalid or unconstitutional, such validity or unconstitutionality shall not affect the validity or constitutionality of the remaining sections, paragraphs, sentences, clauses or phrases. SECTION 10. EFFECTIVE DATE. This Ordinance shall take effect thirty (30) days following its final passage. SECTION 11. PUBLICATION. The City Clerk shall either (a) have this Ordinance published once within 15 (fifteen) days after adoption in a newspaper of general circulation or, (b) have a summary of this Ordinance published twice in a newspaper of general circulation once five days before its adoption and again within 15 (fifteen) days after adoption. SECTION 12. CODIFICATION. Sections Two, Three, Four, Five, Six, Seven and Eight shall be codified in the Danville Municipal Code. Sections One, Nine, Ten and Eleven shall NOT be so codified.
