AN ORDINANCE OF THE TOWN OF DANVILLE APPROVING OF A DEVELOPMENT
AGREEMENT BETWEEN THE TOWN OF DANVILLE AND DIABLO
RANCH DEVELOPMENT COMPANY PERTAINING TO
THE MAGEE RANCH RESIDENTIAL
HOUSING PROJECT
The Town Council of the Town of Danville DOES ORDAIN AS FOLLOWS:
SECTION 1. Findings.
The Town Council finds as follows:

Diablo Ranch Development Company has made application for a
Development Agreement to allow the applicant to obtain a single Final
Map for the entire remainder of the property, and pay all applicable fees
on such Final Map at the time of recordation. Following issuance of the
Final Map the applicant's vested rights would continue for a period of ten
years.

The Magee Ranch project as approved includes 259 single family lots on
an approximately 583 acre site. 176 of the 259 lots have been previously
recorded.

The Danville Planning Commission held a public hearing to consider the
Development Agreement on September 13, 1994. At that meeting the
Planning Commission unanimously recommended that the Town Council
approve the development agreement.

The proposed Development Agreement is consistent with the objectives,
policies, general land uses and programs specified in the general plan
and any applicable specific plan.

The proposed Development Agreement is compatible with the uses
authorized in, and the regulations prescribed for, the land use district in
which the real property is located.
.
The proposed Development Agreement is in conformity with the public
convenience, general welfare and good land use practice.
.
The proposed Development Agreement will not be detrimental to the
health, safety and general welfare.

The proposed Development Agreement will not adversely affect the
orderly development of property or the preservation of property value.
SECTION 2.
Approval of Development Agreement.
The development Agreement titled "Development Agreement between the Town of
Danville and Diablo Ranch Development Company", copies of which is on file in the
offices of the City Clerk, the Town of Danville, 510 La Gonda Way, Danville, CA., is
hereby approved.
SECTION 3.
Publication.
The City Clerk shall either a) have this Ordinance published once within 15 days after
adoption in a newspaper of general circulation or b) have a summary of this
ordinance published twice in a newspaper of general circulation once five days before
it's adoption and again within 15 days after adoption.
SECTION 4.
Effective Date.
This Ordinance becomes effective 30 days after its adoption.
SECTION 5.
Codification.
Sections Two, Three, and Four shall be codified in the Danville Municipal Code.
Section One shall NOT be codified in the Danville Municipal Code.
The foregoing ordinance was first read and introduced on October 4, 1994 and
approved and adopted by the Danville Town Council at a Regular Meeting held on
Tuesday, October 18, 1994 by the following vote:
