AN ORDINANCE OF THE TOWN OF DA~VILLE
AMENDING ARTICLE 4-5 OF THE DANVILLE
MUNICIPAL CODE RELATING TO TRESPASS
ON PRIVATE PROPERTY
THE TOWN COUNCIL OF THE TOWN OF DANVILLE DOES ORDAIN AS
FOLLOWS:
SECTION ONE. FINDINGS AND PURPOSE. The Town Council of the Town of
Danville finds that persons visiting private commercial property open to the public may at
times engage in activities which pose a risk of personal injury to themselves or others,
property damage, or otherwise interfere with the ptlblic health and safety of business activities
undertaken at such property. The purpose of this ordinance is to provide a means by which
such private property owners and businesses may enlist the assistance of law enforcement
officers to abate such activities, consistent with statutory and constitutional safeguards.
SECTION TWO. Amendment of Section 4-5.1a. Section 4-5.1a. of the Danville Municipal
Code is hereby amended to read as follows:
a. No person may remain upon private property or business premises after being
requested to leave the property by the owner, lessee or other person in charge
of the property, or by a Law Enforcement Officer acting at the reasonable
request of such owner, lessee or person in charge of such property, when such
request is made because of activities on the part of the person being requested
to leave which include, without limitation, interference with the peaceful
conduct of a lawful business.
SECTION THREE. CODIFICATION.
Section Two hereof shall be codified in the Danville Municipal Code. Sections ONE and
THREE shall NOT be codified in the Danville Municipal Code.
The foregoing ordinance was first read and introduced on May 3, 1994 and approved and
adopted by the Danville Town Council at a Regular Meeting held on Tuesday, May 17, 1994,
by the following vote:
