HomeMy WebLinkAbout93-08 ORDINANCE NO. 93-8 AN ORDINANCE OF THE TOWN OF DANVILLE APPROVING PRELIMINARY DEVELOPMENT PLAN - REZONING REQUEST PUD 93-2 REZONING 7.15+ ACRES FROM P-l; PLANNED UNIT DEVELOPMENT DISTRICT TO A NEW P-l; PLANNED UNIT DEVELOPMENT DISTRICT FOR AN 88-UNIT SINGLE FAMILY RESIDENTIAL DEVELOPMENT FOR PACIFIC UNION VENTURES (APPLICANTS) AND FOR SAN RAMON VALLEY UNIFIED SCHOOL DISTRICT AND THE DANVILLE COMMUNITY DEVELOPMENT AGENCY (OWNERS) - CHARLOTTE WOOD INTERMEDIATE SCHOOL SITE AND #1 HARTZ COURT The Town Council of the Town of Danville DOES ORDAIN AS FOLLOWS: SECTION 1. Rezoning. The 7.15_+ acre subject property being the easterly portion of the vacated Charlotte Wood Intermediate School site and #1 Hartz Court, fronting at the northwest corner of the intersection of Hartz Court and Hartz Way (APN 216-110-002 and 216-11-007) is hereby rezoned from a P-l; Planned Unit Development District to a new P-l; Planned Unit Development District. Rezoning is based on the approved Preliminary Development Plan - Rezoning request PUD 93-2 and the Findings and Conditions of Approval for that request - see Attachment A of Town Council Resolution No. 98-93; SECTION 2. The City Clerk shall either a) have this Ordinance published once within 15 days after the adoption in a newspaper of general circulation or b) have a summary of this Ordinance published twice in a newspaper of general circulation once five days before it's adoption and again within 15 days after adoption. SECTION 4. Effective Date. This Ordinance becomes effective 30 days after its adoption. SECTION 5. Codification. Sections Two, Three and Four shall be codified in the Danville Municipal Code. Section One shall not be codified in the Danville Municipal Code. The petition contained 2,344 qualified signatures and 2,397 were required. I have enclosed a copy of the Status of Petition Signature Checking issued by the Registrar's Office as well as the certificate showing the results of the examination.
