AN ORDINANCE OF THE TOWN OF DANVILLE AMENDING CHAPTER X OF THE
DANVILLE MUNICIPAL CODE, RELATING TO ELECTRICAL PERMIT FEES, SWIMMING
POOLS, INCORPORATING THE UNIFORM BUILDING CODE STANDARDS, ADOPTING
THE 1990 EDITION OF THE NATIONAL ELECTRICAL CODE, THE 1991 EDITIONS OF
THE UNIFORM BUILDING CODE, THE UNIFORM PLUMBING CODE AND THE
UNIFORM MECHANICAL CODE, THE UNIFORM ADMINISTRATIVE CODE, THE UNIFORM
HOUSING CODE, THE CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS, AND
THE UNIFORM BUILDING SECURITY CODE.
SECTION ONE. Amendment of Sections 10-1.1, 10-2.1, 10-4.1, 10-5.1, 10-6.1, 10-8.1,
10-9.1. Sections 10-1.1, 10-2.1, 10-4.1, 10-5.1, 10-6.1, 10-8.1, 10-9.1 of the Danville
Municipal Code are hereby amended by deleting the word "1988" wherever it appears
therein, and adding in place thereof the word "1991".
SECTION TWO. Amendment of Section 10-1.2e. Section 10-1.2e of the Danville
Municipal Code is hereby amended by deleting the following text: "as set forth in Tables
No. 3-B, 3-C and 3-D."
SECTION THREE. Amendment of Sections 10-2.1, 10-4.1, 10-5.1. Sections 10-2.1, 10-4.1
and 10-5.1 of the Danville Municipal Code are hereby amended by deleting the word
"1989" therefrom and adding in place thereof the word "1991".
SECTION FOUR. Amendment of Section 10-3.1a. Section 10-3.1a of the Danville
Municipal Code is hereby amended to read as follows:
"The National Electrical Code, 1990 Edition, including the 1991 State of California
Amendments as published by the International Conference of Building Officials is
adopted in its entirety as authorized by Section 50010 et seq. of the Government
Code.
SECTION FIVE. Addition of Section 10-3.3. Section 10-3.3 is hereby added to the
Danville Municipal Code, to read as follows:
"10-3.3 Cost of Permit. Permit fees shall be equal to 20% of building inspection
fees."

SECTION SIX. Amendment of Section 10-10.2. Section 10-10.2 is hereby amended
by deleting subsection g thereof and adding new subsections g and h thereto, to read as
follows:
g. Alternatives. Upon written approval of the Chief Building Official, one of
the following may be provided in lieu of the section of the fence enclosure
separating the dwelling house (residence) from the pool:
(a) A safety-type automatic pool cover or a po01 dome;
(b) An alarm capable of detecting unauthorized entry into the pool which
when activated emits a sound of sufficient volume to be heard in the
dwelling.
(c) An audible alarm(s) on all exits of the dwelling opening to the pool;
(d) Listed self-closing and self-latching devices on all exits from the
dwelling opening to the pool.
h. Appeal. Any person dissatisfied with the decision of the Building Official in
his application of this section may submit an appeal of such decision to the
Board of Building Appeals. The method of appeal shall be as described in
Chapter I, Sections 1-8 through 1-8.5.

SECTION SEVEN. Addition of Section 10-10.3. Section 10-10.3 is hereby added to the
Danville Municipal Code, to read as follows:
10-10.3 EXISTING POOLS
a. Purpose. To significantly reduce the threat to public safety posed by
unfenced swimming pools.
b. Date. For any swimming pool constructed pursuant to a swimming
pool permit issued prior to September 15, 1987, an approved fence
shall meet the requirements of this article.

c. Fencing.
(1) Every owner, purchaser under contract, lessee, licensee or
possessor of real property upon which is situated an existing
swimming pool or other out-of-doors body of water containing
a water depth of eighteen inches or surface area of two
hundred fifty square feet, designed, constructed or used for
swimming, dipping or immersion by humans, shall install and
maintain a fence or wall as set forth in this Section. Such
fence or wall shall be not less than four and one-half feet high,
with openings, holes, or gaps therein no larger than four
inches measured hortontally, except for doors or gates. A
perimeter property line fence is acceptable provided it meets
the above requirements. A dwelling house or accessory
building may be used as a part of either such enclosure. The
fence shall be installed before the pool is put in use.
(2) All gates or doors opening through such enclosure shall be
equipped with a self-closing and self-latching device designed
to keep, and capable of keeping, such door or gate securely
closed at all times when not in actual use; provided, however,
that the door of any dwelling occupied by human beings and
forming a part of the enclosure hereinabove required need
not be so equipped, with the exception of breezeways, back
doors of garages, and similar structures, affording access to
the pool, which shall be s,elf-closing and self-latching , with
such latching device placec[ at least four feet above the ground
level, or otherwise made inaccessible from the outside to small
children.
SECTION EIGHT. Addition of Section 10-12. Section 10-12 is hereby added to the
Danville Municipal Code, to read as follows:
"The Uniform Building Code Standards, 1991 Edition, as published by the
International Conference of Building Officials, is hereby adopted in its entirety as

The foregoing ordinance was introduced as a meeting of the Town Council of the Town
of Danville held on October 1, 1991, and was adopted and ordered published at a
meeting of the Council held on October 15, 1991, by the following vote:
