HomeMy WebLinkAbout91-24 ORDINANCE NO. 91-24 AN ORDINANCE OF THE TOWN OF DANVILLE ADDING SECTIONS 4-6.1 AND 4-6.2 OF CHAPTER IV TO THE DANVILLE MUNICIPAL CODE RELATING TO REGULATING, PROHIBITING OR RESTRICTING THE PARKING OF VEHICLES ON TOWN PROPERTY. THE TOWN COUNCIL OF THE TOWN OF DANVILLE DOES ORDAIN AS FOLLOWS: SECTION 1. PURPOSE AND INTENT: The purpose and intent of this Ordinance is to regulate, prohibit or restrict the parking of vehicles on Town property. In this regard, the Danville Town Council hereby finds, based upon the staff report submitted herewith, oral and documentary evidence submitted to the Town Council at a public hearing on September 17, 1991, that the orderly, efficient conduct of the Town's business requires that parking or standing of vehicles on Town property be prohibited, limited or restricted in appropriate circumstances. SECTION 2. SECTION 4-6.1, "PARKING ON TOWN PROPERTY" ADDED: Section 4-6.1, "Parking on Town Property", is hereby added to the Danville Municipal Code, and such Section shall read as follows: "PARKING ON TOWN PROPERTY" Whenever the Town Manager or the Manager's designee shall determine that the orderly, efficient conduct of the Town's business requires that parking or standing of vehicles on Town property be prohibited, limited, or restricted, the Town Manager or the Manager's Designee shall order signs or markings to be installed, indicating that the parking of vehicles is prohibited, limited, or restricted. When the signs or markings authorized by the provisions of this section are in place, it shall be unlawful for any person to park or stand any vehicle contrary to the directions or provisions of such signs or markings. SECTION 3. SECTION 4-6.2, "PENALTIES" ADDED: Section 4-6.1, "Penalties" is hereby added to the Danville Municipal Code, to read as follows: Violation of this ordinance shall be an infraction, punishable by a fine of fifteen dollars per violation. SECTION 4. SEVERABILITY. The Town Council hereby declares that every section, paragraph, clause and phrase are severable. If any section, paragraph, sentence, clause or phrase of this Ordinance is for any reason held to be invalid or unconstitutional, such invalidity or constitutionality of the remaining sections, paragraphs, sentences, clauses or phrases. SECTION 5. EFFECTIVE DATE. This ordinance shall take effect thirty (30) days following its final passage. SECTION 6. REPORTSThe Town Manager or the Manager's designee shall report any changes made in parking regulations pursuant to this ordinance to the Town Council at least semi-annually. SECTION 7. CODIFICATION: Sections Two and Three shall be codified in the Danville Municipal Code. Sections One, Four, Five, Six, Seven, Eight, and nine shall NOT be so codified.
