HomeMy WebLinkAbout91-23 Ordinance 91-23 AN ORDINANCE OF THE TOWN OF DANVILLE ADOPTING THE NEGATIVE DECLARATION OF ENVIRONMENTAL SIGNIFICANCE AND APPROVING A REZONING REQUEST TO REZONE 13.33 +/- ACRES FROM P-l; PLANNED UNIT DEVELOPMENT DISTRICT TO P-l; PLANNED UNIT DEVELOPMENT DISTRICT IN CONJUNCTION WITH A PRELIMINARY AND FINAL DEVELOPMENT PLAN (PUD 91-01 & DP 91-32) AND VESTING TENTATIVE MAP SD 7579 THE TOWN COUNCIL OF THE TOWN OF DANVIIJ.E DOES ORDAIN AS FOLLOWS: SECTION 1. Rezoning. That the 13.3 +/- acre parcel located east of Crow Canyon Road, south of Center Way and west of Tassajara Ranch Road (APN:206-010-012) is Rezoned from P-l; Planned Unit Development District; to a new P-l; Planned Unit Development District. The Town of Danville hereby finds as follows in support of the Rezoning request: 1. The proposed project is consistent with the Danville 2005 General Plan. 2. The residential development will constitute a residential environment of sustained desirability and stability, and will be in harmony with the character of the surrounding neighborhood and community. 3. The development will mitigate off-site traffic and drainage impacts through the assurance of off-site improvements in a manner acceptable to the Town. 4. There is no evidence before the Town that the proposed project will have potential for an adverse effect on wildlife resources or the habitat upon which the wildlife depends. SECTION 2. Zoning Map. Publicaf'"']_ '~' The City Clerk shall either a) have this Ordinance published once within 15 days after adoption in a newspaper of general circulation or b) have a summary of this ordinance published twice in a newspaper of general circulation once five days before it's adoption and again within 15 days after adoption. SECTION 4. Effective Date. This Ordinance becomes effective 30 days after its adoption.
