HomeMy WebLinkAbout91-21 ORDINANCE NO. 91-21 AMENDING ORDINANCE NO.s 93 AND 89-19 TO ADJUST THE COMPENSATION OF TOWN COUNCILMEMBERS The Town Council of the Town of Danville does hereby ordain as follows: SECTION 1: AMENDMENT OF CHAPTER 1, ARTICLE 1, SECTION 2-103(a). Chapter 1, Article 1, Section 2-103 (a) of the Municipal Code of the Town of Danville is hereby amended to read as follows: "(a) Amount. Under the authority of Government Code Sections 36516 and 36516.5, each member of the Town Council shall receive compensation in the amount of $ 379.50 per month, payable at the same time and in the same manner as the salary paid to the officers and employees of the Town." SECTION 2: EFFECTIVE DATE. This Ordinance shall become effective on January 1, 1992. The foregoing Ordinance was introduced at a meeting of the Town Council of Danville held on August 6, 1991 and was adopted and ordered published at a meeting of the Council on September 3, 1991 by the following vote: AYES: Greenberg, Lane, Ritchey, Shimansky NOES: None ABSENT: Schlendorf ABSTAIN None MAYOR ATTEST: APPROVED AS TO FORM: CITY CLERK CITY ATTORNEY coPY ORDINANCE NO. 89-19 AMENDING ORDINANCE NO. 93 TO INCREASE THE COMPENSATION OF TOWN COUNCILMEMBERS The Town Council of the Town of Danville does ordain as follows: SECTION 1: AMENDMENT OF CHAPTER 1o ARTICLE 1. SECTION 2-103(a). Chapter 1, Article 1, Section 2-103(a) of the Municipal Code of the Town of Danville is hereby amended to read as follows: "(a) Amount. Under the authority of Government Code Sections 36516 and 36516.5, each member of the Town Council shall receive compensation in the amount of $345.00 per month, payable at the same time and in the same manner as the salary paid to officers and employees of the Town." t SECTION 2: EFFECTIVE DATE. This Ordinance shall become effective thirty days after its adoption. Sections 2-101---2-105 are added to the Danville Municipal Coda to read as follows: Chapter 1. City Council Article 1. Compensation. Section 2-101. Authority ~or enactment. Section 2-102. City population. Section 2-103. Salary. Section 2-104. Increase or decrease in salary based upon population. Section 2-105. Additional compensation. ...... Section 2-101 Authority for enactment. Sectione 2-101 through 2-105 are enacted under Government Code section 36516 which authorizes a city council to provide by ordinance that each member of the council may receive a salary based upon the population of the city.. Section 2-102. City population. The latest estimate of population of the city is 28,000 . Bootion 2-103. Salary. (a) Amount. Under the authority of Government Code sections 36516 and 36516.6, each member of the city council may receive the sum of $300.00 a month. The salary is payable beginning August 1, 1986, and is payable at the same time and in the same manner as the salary paid to officers and employees of the city. (b) Increase in amount. The salary provided in subsection (a) may be increased beyond the amount so provided. However, the increase shall be by ordinance and may not ~c~d an amount equal to 5% for each calendar year from the operative date of the last adjustment. Section 2-104. Increase or decrease in salary based on poDulation. When the federal census or the State Department of Finance makes a new estimate of the population placing the city in a population group other than the population group used to set the salary provided for in section 2-103 the salary payable to each member of the council may be increased or decreased, as the case may be, in order to equal the sum set forth for the applicable population group in Government Code section 36516. However, the increase or the decrease in the salary becomes payable only after the date when one or more members of the council become eligible for the new salary by beginning a new term of office following the succeeding general municipal election held in the city. Section 2-105. Additional comDensation. The salary prescribed by section 2-103 is exclusive of any other amount payable to a member of the council as reimbursement for actual and necessary expenses incurred in the performance of official duties. e SECTION 2. Publication. The City Clerk shall have this ordinance published once within 15 days after adoption in a newspaper of general circulation. .... SECTION 3. Effective Date. This ordinance becomes effective 30 days after its adoption.
