HomeMy WebLinkAbout91-05 ORDINANCE NO. 91-5 AN ORDINANCE OF THE TOWN OF DANVILLE ADDING SECTION 10-1.25 TO THE DANVILLE MUNICIPAL CODE ADOPTING AND APPROVING AN INCREASE IN THE STRONG MOTION INSTRUMENTATION PROGRAM FEE REQUIRED BY THE STATE OF CALIFORNIA. THE TOWN COUNCIL OF THE TOWN OF DANVILLE DOES ORDAIN AS FOLLOWS: SECTION 1. Purpose. Assembly Bill 3897 establishes fees for the Strong Motion Instrumentation Program (SMIP) at $10 per $100,000 valuation for group R occupancy and $21 per $100,000 valuation for all other building types. This increase will go into effect on April 1, 1991. Further, Assembly Bill 3897 allows Cities to retain five percent (5%) of the total amount collected for data utilization and seismic education. The purpose of this Ordinance is to adopt such fee structure, incompliance with state law. SECTION 2. Addition of Section 10-1.25. Section 10-1.25 is hereby added to the Danville Municipal Code to read as follows: 10-1.25. Strong Motion Instrumentation Fee. A Strong Motion Instrumentation Fee often dollars ($10) per one hundred thousand dollars ($100,000) valuation for any Group R occupancies, and twenty-one dollars ($21) per one hundred thousand dollars ($100,000) valuation for all other building types shall be collected as a part of the basic building permit fee. SECTION 3. Codification. Only Section 2 hereof shall be codified in the Danville Municipal Code. SECTION 4. Effective Date. This ordinance is an urgency ordinance which shall take effect immediately, and because the proceeds of the SMIP fee allow for the state to procure seismic safety equipment and seismic mapping which is necessary to preserve the public peace, health and safety. osrg1279 ' ' The foregoing ordinance was adopted at a meeting of the Town Council of the Town of Danville held on April 2, 1991 by the following vote: AYES: Greenberg, Lane, Ritchey, Schlendor£, Shtmansky NOES: None ABSTAINED: None ABSENT: None AT~ CITY CLERK CI '~' osrg1279
