HomeMy WebLinkAbout90-20 ORDINANCE NO. 90-20 AN ORDINANCE OF THE TOWN OF DANVILLE REPEALING AND ADDING CERTAIN SECTIONS OF ARTICLE 26-2.28 (FEES) OF THE DANVILLE MUNICIPAL CODE REGARDING FEES FOR PLANNING AND RELATED SERVICES. THE TOWN COUNCIL OF THE TOWN OF DANVILLE DOES ORDAIN AS FOLLOWS: SECTION 1. Purpose. The Town Council has determined that the present fees for those services are inadequate to cover the Town's reasonable cost of providing the services. It is necessary for the Town to revise its fee schedule to insure that charges compare more directly to the cost of processing services provided by the Town and to insure that the fees collected are both reasonable and non-discriminatory. Town staff has evaluated the costs of providing planning and related services and has recommended a revised fee schedule. SECTION 2. Findinq. Due to the wide variety of Town planning, engineering and related services provided and because the scope and complexity of each project and application differ, the actual cost of providing services cannot be determined precisely. The fees established herein represent the estimated reasonable cost of providing services for which the fees are charged. SECTION 3. Fee Schedule - Specific. Section 26-2.2803(b) of the Danville Municipal Code is hereby amended to read as follows: "Section 26-2.2803(b). Amount of Fee. Depending upon the request, the fee for service shall be as follows: ENGINEERING SERVICE FEE FOR SERVICE 1. Map Check 2-10 lots $1000+$100/lot Review of parcel/final map. 11 greater $2000+$10/lot 2. Improvement Plan Check 3.5% of projects less Reviews of improvement plans than $50K for street and drainage 3.25% of projects improvements. $50K to $100K 3% of projects $100K and above. 3. Engineering Inspection 5.5% of projects less Inspection of installation than $50K of street and drainage 5.25% of projects improvements. $50K to $100K 5% of projects $100K and above. 1 4. Street Liqhting One year operational Operation of public street cost + 10%. lighting system. 5. Encroachment Permit $80 minimum of 5.5% Work within public of construction cost right-of-way. of large projects. 6. Drainaqe Permit $80 minimum or 5.5% Work within any of construction cost drainage easement. of large projects. PLANNING SERVICES FEE FOR SERVICE 1. Environmental Assessment Initial Study* (Standard Neg. Dec.) $100 Initial Study (Mitigated Neg. Dec.) $275 Environmental Impact Report No Change (Cost + 30%) * Unless qualifying for a categorical exemption pursuant to CEQA, all projects must undergo an initial study. 2. Building Permit Plan Check $5 for all permits for valuations up to $15,000, thereafter fee shall be $10 for each $100,000 valuation or portion thereof, up to a maximum fee of $100 18. Special Planning Studies Cost + 30% 19. Parcel Merger $275 per lot * - Unless qualify for a categorical exemption pursuant to CEQA, all projects must undergo an initial study. The legislative body may amend this fee schedule annually. 4 SECTION 4. Codification. Only Section 3 hereof shall be codified in the Danville Municipal Code.
