AN ORDINANCE OF THE TOWN OF DANVILLE
~MENDING SECTIONS 3-201, 3-203 AND 3-205 OF THE
DANVILLE MUNICIPAL CODEr RELATING TO AN ALTERNATE
MEMBER OF THE PARK AND LEISURE SERVICES COMMISSION
The Town Council of the Town of Danville does Ordain as
follows:
SECTION ONE - PURPOSE AND INTENT. The purpose of this
Ordinance is to provide for the addition of an alternate member to
the Park and Leisure Services Commission. It is the Town Council's
intent that the alternate member attend all meetings of the
commission and enjoy all rights, privileges and duties of a regular
Commission member, including the right to vote and participate in
the deliberations on Commission business in the absence of a
regular Commission member.
SECTION TWO - AMENDMENT OF SECTION 3-201. Section 3-201 of
the Danville Municipal Code is hereby amended to read as follows:
SECTION 3-201. CREATION OF TOWN PARK AND LEISURE SERVICES
COMMISSION.
A Park and Leisure Services Commission of the Town of Danville
is hereby established. The Park and Leisure Services
Commission consists of seven regular members and one alternate
member, all of which shall be appointed by the Town council.
SECTION THREE - AMENDMENT OF SECTION 3-203. Section 3-203 of
the Danville Municipal Code is hereby amended to read as follows:
SECTION 3-203. TERM OF OFFICE.
The term of office of each regular member is four years. Each
regular member serves until his successor is appointed and
qualified. The term of office of the alternate member is two
years from the date of first appointment. The provisions of
this Chapter relating to the creation, term of office and
duties of the alternate member of the Commission shall
automatically expire on June 30, 1992 unless prior to such
date the Town Council shall have enacted an ordinance
repealing or amending this provision.
SECTION FOUR - AMENDMENT OF SECTION 3-205. Section 3-205 of
the Danville Municipal Code is hereby amended to read as follows:
SECTION 3-205. ABSENCE FROM MEETING; DUTIES OF ALTERNATE
MEMBER.
If a member of the Commission is absent without cause
from three regular meetings of the Commission in a twelve-

month period, the office becomes vacant automatically. The
Commission shall immediately notify the Town Council of the
vacancy.
A member is not absent without cause if the absence is
(1) due to illness or (2) unavoidable and the member gives the
secretary of the Commission notice before the day of the
meeting giving the reason for the absence.
"Absence" as used in this Section shall not mean or
include the situation where a member abstains from one or more
items or is otherwise present but disqualified from
participation.
The alternate member of the Commission shall attend all
regular and special meetings of the Commission. If a member
of the Commission is absent for any reason from all or any
part of a regular or special meeting of the Commission, the
alternate member shall participate in such meeting during the
period of such absence. During such participation, the
alternate member shall receive and exercise all rights and
privileges of a regular member, including the right to vote on
matters before the Commission. The Commission shall adopt
such rules as are necessary and desirable to effectuate the
purposes of this Section.
SECTION FIVE - CODIFICATION. Only Sections Two, Three and Four
hereof shall be codified in the Danville Municipal Code.
The foregoing Ordinance was introduced on July 17, 1990 and
approved and adopted by the Town Council of the Town of Danville at
a Regular Meeting held on August 7, 1990 by the following vote:
