HomeMy WebLinkAbout90-04 ORDINANCE NO. 90-4 ADDING CHAPTER 2-12 OF TITLE i TO THE DANVILLE MUNICIPAL CODE RELATING TO THE CREATION OF THE DANVILLE ARTS COMMISSION THE TOWN COUNCIL OF THE TOWN OF DANVILLE DOES ORDAIN AS FOLLOWS: SECTION 1. PURPOSE. The purpose of this Ordinance is to create the Danville Arts Commission. The Commission shall promote interest in and support for the arts, and shall formulate recommendations for the arts and cultural facilities in Danville. SECTION 2. CREATION OF DANVILLE ARTS COMMISSION. Chapter 2-12 of Title 1 is hereby added to the Danville Municipal Code, to read as follows: SECTION 2-12.1. CREATION OF DANVILLE ARTS COMMISSION. An Arts Commission of the Town of Danville is hereby established. The Arts Commission shall consist of seven members, who shall be appointed by the Town Council. SECTION 2-12.2. POWERS AND DUTIES. The powers and duties of the Commission are to: (a) Promote interest and support for the arts within the community; (b) Establish and serve as principal liaison with the Danville Area Cultural Alliance, whose primary functions are to raise funds for arts programs, assist in the sponsorship and conduct of arts programs, and to serve as a patron support group for the arts; (c) Inform the community of art and cultural events by the publication of a calendar of art and cultural events; (d) Serve as a liaison to other regional arts organizations; (e) Recommend policies regarding art and cultural activities and facilities to appropriate Town Commissions and the Town Council; (f) Perform such other duties and functions as may be prescribed by the Town Council. 1 SECTION 2-12.3. OUALIFICATIONS. The Council shall, when making appointments to the Commission, give special consideration to persons who are specially qualified by reason of training, experience, interest or involvement in the arts and letters, particularly as related to artistic and cultural activities in the Town of Danville. SECTION 2-12.4. TERM OF OFFICE. The term of office of each member of the Commission is three (3) years. However, of the members first appointed, two (2) shall serve for one (1) year, two (2) shall serve for two (2) years, and three (3) shall serve for three (3) years. Each member shall serve until their successor is appointed and qualified. No member shall serve more than six consecutive years subject to extension by the Town Council. SECTION 2-12.5. TIME AND PLACE OF REGULAR MEETING. The Commission shall regularly meet at a time and place selected by its members. SECTION 2-12.6. OUORUM. A majority of the Commission shall constitute a quorum for the transaction of business. SECTION 2-12.7. ABSENCE FROM MEETING. If a member of the Commission is absent without cause from three (3) consecutive regular meetings of the Commission, that member's office shall be vacant automatically. The Commission shall immediately notify the Town Council of the vacancy. A member is not absent without cause if that member's absence is (1) due to illness or (2) unavoidable, and the member gives the secretary of the Commission notice before the day of the regular meeting at which the member will be absent, and giving the reason for the absence. SECTION 2-12.8. NO COMPENSATION; REIMBURSEMENT OF EXPENSES. Members of the Commission shall not receive compensation for their attendance at Commission meetings, but are entitled to reimbursement for reasonable expenses actually incurred in the course of their duties, provided that such reimbursement shall first be approved by the Town Council. 2 SECTION 2-12.9. BROWN ACT; CONFLICT OF INTEREST CODE. The Commission and each of its members shall be subject to the provisions of the Ralph M. Brown Act, California Government Code, Sections 54950 et seq. The Commission and each of its members shall be subject to the provisions of the Town's Conflict of Interest Code, adopted by Resolution No. 44-85, as such Resolution has been amended in the past and as it may be amended in the future. SECTION 2-12.10. OFFICERS. The Commission shall elect a Chair and a Vice-Chair from among its members. The Chair and the Vice-Chair serve for a term of one year and until the successor of each is appointed and qualified. SECTION 2-12.11. DUTIES OF OFFICERS. (a) Chair. The Chair shall preside at all meetings of the Commission, shall appoint committees of the Commission as needed, and shall perform such additional duties as are necessary and incidental to the office. (b) Vice-Chair. The Vice-Chair shall perform the duties of the Chair on such occasions as the Chair shall be unavailable or unable to perform such duties. SECTION 2-12.12. ADOPTION OF RULES. The Commission shall adopt rules for the transaction of its business and shall keep a public record of its resolutions, transactions, findings and determinations.
