HomeMy WebLinkAbout89-16 BEFORE THE TOWN COUNCIL OF THE TOWN OF DANVILLE In the Matter of: Approving an amendment to PUD 84-8 ) Ordinance No. 89-16 and DP 84-9 by approving PUD 89-8 ) and DP 89-24 and Amending the ) Zoning Map of the Town. ) The Town Council of the Town of Danville DOES ORDAIN AS FOLLOWS: SECTION 1. Rezoning. That PUD 84-8 and DP 84-9 (adopted by Ord. NO. 55-85) located on Lot 10 of Subdivision 5598 in the Danville Livery and Mercantile Offices is amended to allow a Real Estate use in Building G and a portion of Building F (see Exhibit B). (Assessor's Parcel Number: 208-462-012). Rezoning is based upon the conditions contained in Exhibit A. SECTION 2. Publication. the City Clerk shall either a) have this Ordinance published once within 15 days after adoption in a newspaper of general circulation or b) have a summary of this Ordinance published twice in a newspaper of general circulation once five days before its adoption and again within 15 days after adoption. SECTION 4. Effective Date. This ordinance becomes effective 30 days after its adoption. The foregoing ordinance was introduced at a meeting of the Town Council of the Town of Danville held 10/2 , 1989 and was adopted and ordered published at a meeting of the Council held on 10/16 , 1989, by the following vote: AYES: GREENBERG, JAGGER, LANE, RITCHEY NOES: NQNE ABSTAIN: NONE ABSENT: SCHLENDORF ~ .~ ~" " f~AYOR ATTEST: APPROVED AS TO FORM EXHIBIT A Ordinance 89-16 PUD 89-8 and DP 89-25 (Amending PUD 84-8 and DP 84-9) The Conditions of Approval for PUD 84-8 and DP 84-9 are hereby modified to read as follows: Modify as follows: 2. Uses on the subject property shall be limited to the following list: Realtor ** Accountant Title Company Escrow Office Insurance Finance Architect Engineer Medical-Dental Securities Optometrist-Optician Contractor Commercial Bank * Real Estate Development Savings and Loan * Investment Advisors Attorney Home Security · In Building A only · * In Building A, and in Buildings F and G (to a maximum of 5500 sq. ft. as shown on Exhibit B) Any proposed use not included in but similar in nature and intensity to uses in the above list and permitted under the Limited office ordinance, shall be subject to review and approval by the Chief of Planning. If a proposed use is not typical or ordinary and may be inconsistent with the nature and intensity of the list of uses, the Director may refer it to the Planning Commission for review and recommendation. Add: 41. Real estate occupancy of Building G and a portion of Building F shall be limited to 5500 square feet. Parking for the center shall not become regularly overburdened as a result of this expansion of use. To assure this will not occur, and that there is evidence to suggest such overburdening exists (as determined by the Town), the developer shall fund upon reasonable demand by the Chief of Planning, a third party parking study identifying the parking needs of the center and addressing possible solutions. The owner of the project shall be responsible for the appropriate implementation as determined necessary by the Chief of Planning.
