A new Chapter 5 is added to Title 3 of the Danville Municipal Code to read as follows: "Chapter 5 Heritage Resource Commission Section 3-501 Creation of Heritage Resource Commission Section 3-502 Qualifications Section 3-503 Term of office Section 3-504 Removal or vacancy Section 3-505 Time and place of regular meeting Section 3-506 Absence from meeting Section 3-507 No compensation Section 3-508 officers Section 3-509 Duties of officers of the Commission Section 3-510 Adoption of rules Section 3-511 Quorum Section 3-512 Powers and duties Section 3-501. Creation of Heritage Resource Commission. A Heritage Resource Commission of the Town of Danville is established. The commission consists of seven members appointed by the Town Council. Section 3-502. Oualifications. When making appointments, the Council shall select persons specially qualified by reason of training, experience or interest in the historic and cultural traditions of the town. Membership shall include: (a) one member of the Planning Commission; (b) one person who is knowledgeable in the field of construction or structural rehabilitation, such as a engineer, contractor or urban planner, (c) one licensed architect, (d) one property owner, (e) one person who has demonstrated interest competence or knowledge in the culture/arts of the community; and (f) at least two people who have demonstrated interest, competence or knowledge in the field of history, archaeology or geography. Section 3-503. Term of office. The term of office of each member is three years. However, of the members first appointed, 2 shall serve for one year, 2 for two years 1 and 3 shall serve for three years. Each member serves until his successor is appointed and qualified. No commissioner may serve more than six consecutive years. Section 3-504. Removal or vacancy. A member of the Commission may be removed by a majority vote of the Council. A vacancy is filled in the same manner as the original appointment. A person appointed to fill a vacancy serves for the remainder of the unexpired term. Section 3-505. Time and place of regular meeting. The Commission shall regularly meet at a time and place selected by its members. Section 3-506. Absence from meeting. If a member of the Commission is absent without cause from three successive regular meetings of the Commission, the office becomes vacant automatically. The Commission shall immediately notify the City Council of the vacancy. A member is not absent without bause if his absence is (1) due to illness or (2) unavoidable and the member gives the secretary of the Commission notice before the day of the meeting that he will be absent and giving the reason for the absence. Section 3-507. No compensation. Members of the Heritage Resource Commission do not receive compensation for attendance at Commission meetings, but are entitled to reimbursement for expenses incurred in the course of their duties upon approval by the Town Council. Section 3-508. Officers. The Commission shall elect a Chair and Secretary from among its members. The Chair and Secretary serve for a term of one year and until the successor of each is appointed and qualified. Section 3-509. Duties of officers of the Commission. a. Chair. The Chair shall preside at all meetings of the Commission. The Chair shall appoint all committees and shall perform the duties necessary or incidental to the office. b. Secretary. The Secretary shall keep minutes of each meeting and shall record each hearing and official action. 2 Section 3-510. Adoption of rules. The Commission shall adopt rules for the transaction of its business and shall keep a public record of its resolutions, transactions, findings and determinations. Section 3-511. Ouorum. A majority of the Commission shall constitute a quorum for the transaction of business. Section 3-512. Powers and duties. The powers and duties of the Heritage Resource Commission are to: (1) establish criteria and conduct an ongoing comprehensive survey of properties within the boundaries of the Town in order to identify historically and architecturally significant improvements and sites that exemplify the cultural, social, educational, economic, political or architectural history of the nation, state or city; (2) establish and maintain an inventory of improvements, sites and areas deemed deserving of official recognition and to investigate and recommend to the Town Council the designation of those improvements, sites or areas having special historic, community or architectural value; (3) draft and implement a Heritage Resource Ordinance to protect and preserve those resources to be designated by the Commission; (4) keep a register of officially designated heritage resources in the town, including all information required for each designation; (5) recommend to the Town Council a list of incentives and promote its use in encouraging property owners to participate in the heritage resource preservation program. (6) advise and assist property owners on the physical and financial aspects of preservation, renovation, rehabilitation, landscaping or maintenance of any heritage resource; (7) develop and adopt standards and specific design guidelines for the alteration, construction, rehabilitation or removal of designated improvements; (8) review and decide upon applications referred by the planning department for construction, alteration, removal or demolition affecting improvements, as well as applications for grading, tree removal, or other work to be performed upon sites of historical significance; (9) inform and educate the citizens of Danville as to the heritage of the town and to encourage their participation in achieving historical and architectural preservation; (10) investigate and report to the Town Council on the use of various federal, state, local or private funding sources and mechanisms available to promote historic resource preservation in the Town; and (11) cooperate with local, county, state and federal governments in the pursuit of the objectives of historic preservation. (12) perform such other duties and functions as prescribed by the Town Council. SECTION 2. Review. The Town Council intends to review the operations of the Heritage Resource Commission at the end of the first two years of its existence. The staff is directed to agendize an item calling for the Town Council to review the functions, operationsand need for continued existence of the Heritage Resource Commission at the Town Council's first meeting in June 1990. SECTION 3. Effective Date. This ordinance becomes effective 30 days after its adoption. SECTION 4. Publication. The Town Clerk shall either a) have this ordinance published once within 15 days after adoption in a newspaper of general circulation or b) have a summary of this ordinance published twice in a newspaper of general circulation, once five days before its adoption and again within 15 days after adoption. The foregoing ordinance was introduced at a meeting of the Town Council of the Town of Danville held on June 7 , 1988, and was adopted and ordered published at a meeting of the Council held on June 20 , 1988, by the following vote: AYES: Greenberg, Jagger, Lane, Ritchey, Schlendorf NOES: None ABSTAIN: None ABSENT: None ~ YOR ATTEST: ~ ~OWN CLERK 4
