Rezoning. That the .45 ± acre parcel located at 809 Podva Road (APN: 208-462-013) otherwise known as the Podva House, and shown on the attached Exhibit B is rezoned from R-15 to 0-1 zoning district. Rezoning is based on the Findings attached in Exhibit A. Section 2. Publication. The Town Clerk shall either a) have this ordinance published once within fifteen days after adoption in a newspaper of general circulation or b) have a summary of this ordinance published twice in a newspaper of general circulation once five days before its adoption and again within fifteen days after adoption. The foregoing ordinance was introduced at a meeting of the Town Council of the Town of Danville at a meeting held on December 7, 1987, and was adopted and ordered published at a meeting held on January 4 , 1988 by the following vote: AYES: Greenberg, Kennett, Lane, Ritchey, Schlendorf NOES: None ABSENT: None ABSTAIN: None J~ ...... ATTEST: ~-Tow~Clerk apmp2 ? Exhibit A FINDINGS RZ 87-2 Podva House I. Findings The Town of Danville herby finds as follows in support of the rezoning to 0-1: 1. The proposed rezoning is in conformance with the General Plan goals and policies. 2. The use authorized and proposed is compatible within the district and will serve as an appropriate transition to the single family residential uses south of this site. 3. Community need has been demonstrated by previously granting a land use permit to allow office uses on this site in a residential zoning district. II. Conditions of Approval 1. Upon construction of the improvements permitted by this entitlement, no further development shall occur on this site pursuant to the adopted general plan. 2. Upon adoption by the Town of a Historic Preservation Ordinance, the Podva House shall be registered as a Historic Structure, pursuant to the adopted general plan. 3.
